                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to making emergency appropriations.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  TEXAS DEPARTMENT OF HEALTH: HIGHER THAN EXPECTED
 1-5     MEDICAID COSTS.  (a)  In addition to amounts previously
 1-6     appropriated for the current fiscal biennium, the sum of $1 million
 1-7     is appropriated out of the general revenue fund to the Texas
 1-8     Department of Health for the remainder of the fiscal year ending
 1-9     August 31, 2001, for the purpose of providing services under the
1-10     state Medicaid program, including, but not limited to, purchased
1-11     premium health services, prescription drug services, medical
1-12     transportation, and preventive health services that primarily
1-13     benefit children.
1-14           (b)  Funds appropriated by Subsection (a) of this section may
1-15     be expended only for the purposes described by Subsection (a) of
1-16     this section and only if:
1-17                 (1)  Medicaid expenditures exceed otherwise available
1-18     revenue because of changes in caseloads and costs; and
1-19                 (2)  the Texas Department of Health has used all
1-20     revenue available to the Medicaid program, including but not
1-21     limited to premium credits and vendor drug rebates.
1-22           SECTION 2.  TEXAS DEPARTMENT OF HEALTH: LESS FAVORABLE
1-23     FEDERAL MEDICAL ASSISTANCE PERCENTAGE FEDERAL MATCH RATE.  (a)  Due
1-24     to a lower federal match for the Medicaid program, the sum of $45
 2-1     million is appropriated out of the general revenue fund to the
 2-2     Texas Department of Health for the remainder of the fiscal year
 2-3     ending August 31, 2001, in addition to amounts previously
 2-4     appropriated for the current fiscal biennium, for the purpose of
 2-5     providing services under the state Medicaid program.
 2-6           (b)  Funds appropriated by Subsection (a) of this section may
 2-7     be expended only for the purposes described by Subsection (a) of
 2-8     this section and only to the extent expenditures of the funds are
 2-9     necessary to:
2-10                 (1)  offset a lower federal match rate; or
2-11                 (2)  address changes in Medicaid caseloads or costs.
2-12           SECTION 3.  TEXAS DEPARTMENT OF CRIMINAL JUSTICE: CAPACITY.
2-13     In addition to amounts previously appropriated for the current
2-14     fiscal biennium, the sum of $74,600,000 is appropriated out of the
2-15     general revenue fund to the Texas Department of Criminal Justice
2-16     for the remainder of the fiscal year ending August 31, 2001, for
2-17     the purpose of providing for expenditures relating to the operation
2-18     of additional prison capacity and to contracts with counties for
2-19     additional temporary capacity.
2-20           SECTION 4.  TEXAS DEPARTMENT OF CRIMINAL JUSTICE: CAREER
2-21     LADDER ADJUSTMENTS.  In addition to amounts previously appropriated
2-22     for the current fiscal biennium, the sum of $35,700,000 is
2-23     appropriated out of the general revenue fund to the Texas
2-24     Department of Criminal Justice for the remainder of the fiscal year
2-25     ending August 31, 2001, for the purpose of providing for
2-26     expenditures relating to correctional officer, sergeant, and food
2-27     service and laundry manager career ladder salary adjustments.
 3-1           SECTION 5.  EFFECTIVE DATE.  This Act takes effect
 3-2     immediately.
