                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the frequency of municipal bond elections.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Subchapter A, Chapter 1331, Government Code, is
 1-5     amended by adding Section 1331.003 to read as follows:
 1-6           Sec. 1331.003.  FREQUENCY OF BOND ELECTIONS.  (a)  A
 1-7     municipality may not call an election on a bond proposal that
 1-8     failed at an earlier election or on a bond proposal that is similar
 1-9     or related to the earlier bond proposal before the first
1-10     anniversary of the date of the election at which the earlier bond
1-11     proposal failed.
1-12           (b)  The authority responsible for ordering the election on a
1-13     bond proposal shall determine whether the bond proposal is the same
1-14     as or similar or related to a bond proposal that failed at an
1-15     election held within the 12 months preceding the date proposed for
1-16     the election on the new bond proposal.
1-17           SECTION 2.  This Act takes effect September 1, 2001.
