By Carter H.B. No. 1360 77R5003 KLA-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the possession of ammunition or a firearm by certain 1-3 peace officers. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 85.026, Family Code, is amended by adding 1-6 Subsection (d) to read as follows: 1-7 (d) The statements required under Subsection (a) do not 1-8 affect the right of a peace officer listed in Article 2.12, Code of 1-9 Criminal Procedure, or any other law, to possess a firearm or 1-10 ammunition to the extent permitted by federal law under 18 U.S.C. 1-11 Section 925(a), as amended. 1-12 SECTION 2. The change in law made by this Act applies to a 1-13 peace officer who is the subject of an active protective order, 1-14 regardless of whether the protective order was issued before, on, 1-15 or after the effective date of this Act. 1-16 SECTION 3. This Act takes effect immediately if it receives 1-17 a vote of two-thirds of all the members elected to each house, as 1-18 provided by Section 39, Article III, Texas Constitution. If this 1-19 Act does not receive the vote necessary for immediate effect, this 1-20 Act takes effect September 1, 2001.
