A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to protecting, under the public information law, the
1-3 identity of a victim of violence or threatened violence.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 552.108, Government Code, is amended by
1-6 amending Subsection (c) and adding Subsections (d) and (e) to read
1-7 as follows:
1-8 (c) Except as provided by Subsections (d) and (e), this
1-9 [This] section does not except from the requirements of Section
1-10 552.021 information that is basic information about an arrested
1-11 person, an arrest, or a crime.
1-12 (d) Information held by a law enforcement agency or
1-13 prosecutor is excepted from the requirements of Section 552.021 as
1-14 provided by this subsection and Subsection (e) if the information
1-15 reveals or tends to reveal the identity of a victim of:
1-16 (1) an offense under Title 5, Penal Code, Chapter 29,
1-17 Penal Code, or Section 42.072, Penal Code; or
1-18 (2) an offense that is preparatory to an offense
1-19 listed in Subdivision (1).
1-20 (e) Information is excepted from required disclosure under
1-21 Subsection (d) only until the earlier of:
1-22 (1) the date by which each person who committed the
1-23 offense has been apprehended and has been convicted, acquitted of,
1-24 or granted deferred adjudication for the offense; or
2-1 (2) the second anniversary of the date the offense was
2-2 committed.
2-3 SECTION 2. The changes in law made by this Act apply without
2-4 regard to the date on which an offense was committed or the date on
2-5 which information related to the offense was requested under
2-6 Chapter 552, Government Code.
2-7 SECTION 3. This Act takes effect immediately if it receives
2-8 a vote of two-thirds of all the members elected to each house, as
2-9 provided by Section 39, Article III, Texas Constitution. If this
2-10 Act does not receive the vote necessary for immediate effect, this
2-11 Act takes effect September 1, 2001.
