1-1                                   AN ACT
 1-2     relating to use of certain terms by cemeteries.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1. Section 711.021, Health and Safety Code, is
 1-5     amended by adding Subsection (h) to read as follows:
 1-6           (h)  A cemetery corporation, including a corporation
 1-7     described by Subsection (d), that does not operate as a perpetual
 1-8     care cemetery in accordance with Chapter 712 may not use the words
 1-9     "perpetual care" or "endowment care," or any other term that
1-10     suggests "perpetual care" or "endowment care" standards, in:
1-11                 (1)  the cemetery's name; or
1-12                 (2)  any advertising relating to the cemetery.
1-13           SECTION 2. A cemetery corporation that is not in compliance
1-14     with Section 711.021(h)(1), Health and Safety Code, on the
1-15     effective date of this Act, shall amend its articles of
1-16     incorporation to comply with this Act not later than December 31,
1-17     2002.
1-18           SECTION 3. This Act takes effect September 1, 2001.
