No. 1460 1-2 (In the Senate - Received from the House April 9, 2001; 1-3 April 9, 2001, read first time and referred to Committee on State 1-4 Affairs; May 7, 2001, reported favorably by the following vote: 1-5 Yeas 7, Nays 0; May 7, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to use of certain terms by cemeteries. 1-9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-10 SECTION 1. Section 711.021, Health and Safety Code, is 1-11 amended by adding Subsection (h) to read as follows: 1-12 (h) A cemetery corporation, including a corporation 1-13 described by Subsection (d), that does not operate as a perpetual 1-14 care cemetery in accordance with Chapter 712 may not use the words 1-15 "perpetual care" or "endowment care", or any other term that 1-16 suggests "perpetual care" or "endownment care" standards, in: 1-17 (1) the cemetery's name; or 1-18 (2) any advertising relating to the cemetery. 1-19 SECTION 2. A cemetery corporation that is not in compliance 1-20 with Section 711.021(h)(1), Health and Safety Code, on the 1-21 effective date of this Act, shall amend its articles of 1-22 incorporation to comply with this Act not later than December 31, 1-23 2002. 1-24 SECTION 3.
