                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the authority of a public junior college to set reduced
 1-3     tuition rates.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter A, Chapter 130, Education Code, is
 1-6     amended by adding Section 130.0033 to read as follows:
 1-7           Sec. 130.0033.  REDUCED TUITION FOR CERTAIN COURSES.  (a)
 1-8     The governing board of a public junior college district may charge
 1-9     tuition for a course or courses at a rate established by the board
1-10     that is less than the rate otherwise required by Section 54.051 or
1-11     other law if the governing board finds that the reduced tuition
1-12     rate is reasonably necessary to enable the junior college to make
1-13     efficient use of its facilities or faculty or for other good cause.
1-14     The finding must be stated in the order or resolution establishing
1-15     the reduced tuition rate.
1-16           (b)  Charging tuition at a reduced rate under this section
1-17     does not affect the right of the junior college to a proportionate
1-18     share of state appropriations under Section 130.003 for the contact
1-19     hours attributable to students paying tuition at the reduced rate.
1-20           SECTION 2.  (a)  This Act takes effect immediately if it
1-21     receives a vote of two-thirds of all the members elected to each
1-22     house, as provided by Section 39, Article III, Texas Constitution.
1-23     If this Act does not receive the vote necessary for immediate
1-24     effect, this Act takes effect September 1, 2001.
 2-1           (b)  The change in law made by this Act applies beginning
 2-2     with tuition charged for the 2001 fall semester.
