1-7 A BILL TO BE ENTITLED
1-8 AN ACT
1-9 relating to the amount of tuition that a public junior college may
1-10 set aside for Texas Public Education Grants.
1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12 SECTION 1. Section 56.033(a), Education Code, is amended to
1-13 read as follows:
1-14 (a) The governing board [boards] of each institution
1-15 [institutions] of higher education, including [and] the Texas State
1-16 Technical College System, shall cause to be set aside:
1-17 (1) [for the 1991-1992 academic year, not less than
1-18 nine percent nor more than 15 percent out of each resident
1-19 student's tuition charge under Section 54.051 of this code as
1-20 provided by the General Appropriations Act for the applicable
1-21 academic year;]
1-22 [(2) for the 1992-1993 academic year and each
1-23 subsequent academic year,] not less than 15 percent nor more than
1-24 20 percent out of each resident student's tuition charge under
1-25 Section 54.051 [of this code] as provided by the General
1-26 Appropriations Act for the applicable academic year[; in specifying
1-27 the percentage to be set aside for the 1991-1992 and 1992-1993
1-28 academic years, the legislature shall consider the recommendations
1-29 of the Select Committee on Higher Education established by H.C.R.
1-30 No. 105, Acts of the 69th Legislature, Regular Session, 1985];
1-31 (2) [(3)] three percent out of each nonresident
1-32 student's tuition charge under Section 54.051 [of this code];
1-33 (3) not less than [(4)] six percent nor more than 20
1-34 percent out of each resident student's hourly tuition charge, and
1-35 $1.50 out of each nonresident student's hourly tuition charge, for
1-36 academic courses at a public community or [and] junior college
1-37 [colleges]; and
1-38 (4) not less than [(5)] six percent nor more than 20
1-39 percent of hourly tuition charges for vocational-technical courses
1-40 at a public community or [and] junior college [colleges].
1-41 SECTION 2. (a) This Act takes effect immediately if it
1-42 receives a vote of two-thirds of all the members elected to each
1-43 house, as provided by Section 39, Article III, Texas Constitution.
1-44 If this Act does not receive the vote necessary for immediate
1-45 effect, this Act takes effect September 1, 2001.
1-46 (b) The change in law made by this Act applies beginning
1-47 with the 2001 fall semester.
