 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to improvements to county roads and the assessment of
 1-9     costs by the commissioners courts of certain counties.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1. Sections 286.002(a) and (b), Transportation Code,
1-12     are amended to read as follows:
1-13           (a)  The commissioners court of the county may improve a
1-14     county road in the county by:
1-15                 (1)  filling, grading, raising, paving, or repairing
1-16     the road in a permanent manner;
1-17                 (2)  constructing, repairing, or realigning a curb,
1-18     gutter, or sidewalk; [or]
1-19                 (3)  constructing a drain or culvert; or
1-20                 (4)  installing a streetlight.
1-21           (b)  The commissioners court by order may assess against
1-22     property abutting the portion of the county road to be improved and
1-23     against the owners of that property:
1-24                 (1)  all or part of the cost of:
1-25                       (A)  constructing, repairing, or realigning a
1-26     curb, gutter, or sidewalk; or
1-27                       (B)  installing a streetlight; and
1-28                 (2)  not more than nine-tenths of the cost of any other
1-29     improvement.
1-30           SECTION 2.  This Act takes effect immediately if it receives
1-31     a vote of two-thirds of all the members elected to each house, as
1-32     provided by Section 39, Article III, Texas Constitution.  If this
1-33     Act does not receive the vote necessary for immediate effect, this
1-34     Act takes effect September 1, 2001.
