 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to security costs required of a person who contests
 1-9     certain alcoholic beverage license applications.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1. Section 61.39, Alcoholic Beverage Code, is amended
1-12     to read as follows:
1-13           Sec. 61.39.  MAY CONTEST APPLICATION.  Any person may contest
1-14     the facts stated in an application for a license to distribute,
1-15     manufacture, or sell beer at retail, or the applicant's right to
1-16     secure a license, if the person [he] gives security for all costs
1-17     which may be incurred in the contest if the case should be decided
1-18     in favor of the applicant.  No security for costs may be required
1-19     of an officer of a county or incorporated city or town or an
1-20     elected officer of the state or federal government.
1-21           SECTION 2. This Act takes effect September 1, 2001.
