                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the creation of a commercial and industrial development
 1-3     zone; providing authority to impose a tax and issue bonds.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Chapter 376, Local Government Code, is amended by
 1-6     adding Subchapter K to read as follows:
 1-7          SUBCHAPTER K.  COMMERCIAL AND INDUSTRIAL DEVELOPMENT ZONE
 1-8           Sec. 376.451.  CREATION OF DISTRICT.  (a)  The commercial and
 1-9     development zone is created as a special district.
1-10           (b)  The board by resolution may change the district's name.
1-11           Sec. 376.452.  DEFINITIONS.  In this subchapter:
1-12                 (1)  "Board" means the board of directors of the
1-13     development zone.
1-14                 (2)  "County" means Harris County, Texas.
1-15                 (3)  "Development zone" means the commercial and
1-16     industrial development zone created under this subchapter.
1-17           Sec. 376.453.  BOUNDARIES.  The development zone includes all
1-18     the territory contained in the following described area:
1-19     BEGINNING at the intersection of the northeasterly right of way
1-20     line of Aldine Westfield Road and the southwesterly right of way
1-21     line of Farm to Market Road 1960;
1-22     THENCE in a southeasterly direction along that southwesterly right
1-23     of way line of Farm to Market Road 1960 to its intersection with
1-24     the westerly boundary line of the Humble Heights subdivision;
 2-1     THENCE in a southerly direction along that westerly boundary line
 2-2     of the Humble Heights subdivision to its intersection with the
 2-3     northerly right of way line of Spur 184;
 2-4     THENCE continuing in the same course along, the extension of that
 2-5     westerly boundary line of the Humble Heights subdivision to that
 2-6     line's intersection with the southerly right of way line of Spur
 2-7     184;
 2-8     THENCE in an easterly direction along that southerly right of way
 2-9     line of Spur 184 to the northwesterly corner of the Shady Trees
2-10     Addition subdivision;
2-11     THENCE in a southerly direction along the westerly boundary line of
2-12     the Shady Trees Addition subdivision to its southwesterly corner;

46-26          Sec. 376.454.  FINDINGS RELATING TO BOUNDARIES.  The
46-27    boundaries and field notes of the development zone form a closure.
 47-1    If a mistake is made in the field notes or in copying the field
 47-2    notes in the legislative process, the mistake does not in any way
 47-3    affect the zone's:
 47-4                (1)  organization, existence, or validity;
 47-5                (2)  right to issue any type of bond for the purposes
 47-6    for which the zone is created or to pay the principal of and
 47-7    interest on a bond;
 47-8                (3)  right to impose or collect an assessment or tax;
 47-9    or
47-10                (4)  legality or operation.
47-11          Sec. 376.455.  CREATION OF DEVELOPMENT ZONE. The development
47-12    zone is created to promote and encourage:
47-13                (1)  commercial development, including the development
47-14    of businesses in the technology field;
47-15                (2)  workforce development;
47-16                (3)  the improvement of competitiveness in education;
47-17                (4)  public and private sector partnerships; and
47-18                (5)  the revitalization of neighborhoods.
47-19          Sec. 376.456.  INCENTIVES AND PROGRAMS. (a)  The county by
47-20    order must summarize briefly the:
47-21                (1)  incentives, including tax incentives, that the
47-22    designating body chooses to apply to businesses in the development
47-23    zone; or
47-24                (2)  programs to be developed to affect businesses in
47-25    the development zone.
47-26          (b)  The incentives or programs summarized under Subsection
47-27    (a) must include:
 48-1                (1)  an incentive that does not apply to all businesses
 48-2    located in the development zone;
 48-3                (2)  an incentive or program designed to improve the
 48-4    skills of the local labor pool; and
 48-5                (3)  an incentive or program designed to address
 48-6    infrastructure, housing, or other elements essential to improving
 48-7    quality of life.
 48-8          (c)  This section does not prohibit the county from extending
 48-9    additional incentives, including tax incentives, to business
48-10    enterprises in the development zone by a separate order.
48-11          Sec. 376.457.  TAX INCREMENT. The county may allow one
48-12    quarter of one percent of a local property tax increment to fund
48-13    the development zone, as provided by Chapter 311, Tax Code.  On
48-14    adoption of a county order,  the fund may be used to pay salaries
48-15    of employees of the board and administrative expenses of the
48-16    development zone.
48-17          Sec. 376.458.  AMENDING BOUNDARIES. (a)  The county by order
48-18    may amend the boundary of the development zone after a public
48-19    hearing on the issue.
48-20          (b)  The amended boundary:
48-21                (1)  must be continuous; and
48-22                (2)  may not exclude any area originally included
48-23    within the boundary of the development zone.
48-24          (c)  The county may not make more than one boundary amendment
48-25    for the development zone in a calendar year.
48-26          Sec. 376.459.  BOARD OF DIRECTORS. (a)  The development zone
48-27    is governed by a board of nine directors who serve two-year terms,
 49-1    appointed by the commissioners court of the county.
 49-2          (b)  The initial terms of directors may be staggered.
 49-3          Sec. 376.460.  QUALIFICATIONS OF DIRECTORS. To serve as a
 49-4    director, a person must:
 49-5                (1)  be at least 21 years old; and
 49-6                (2)  be registered to vote in the county.
 49-7          Sec. 376.461.  DISQUALIFICATION OF DIRECTORS. Section 49.052,
 49-8    Water Code, applies to directors of the development zone as if the
 49-9    zone were a district governed by that section.
49-10          Sec. 376.462.  BOARD VACANCIES. A vacancy in the office of
49-11    director shall be filled by appointment by the commissioners court
49-12    of the county.
49-13          Sec. 376.463.  REMOVAL OF DIRECTOR. A majority of the board
49-14    may remove a director for misconduct or failure to carry out the
49-15    director's duties.
49-16          Sec. 376.464.  ORGANIZATION OF BOARD. After the appointment
49-17    and qualification of directors by the county, the board shall
49-18    organize by electing a president, a vice president, a secretary,
49-19    and any other officers the board considers necessary.
49-20          Sec. 376.465.  QUORUM; DIRECTOR'S DUTIES; MANAGEMENT OF ZONE.
49-21    Sections 49.053, 49.057, and 49.058, Water Code, apply to the board
49-22    of directors of the development zone as if the zone were a district
49-23    governed by those sections.
49-24          Sec. 376.466.  MEETINGS AND NOTICE. (a)  The board shall
49-25    designate and establish a development zone office in the county.
49-26          (b)  The board may establish regular meetings to conduct
49-27    development zone business and may hold special meetings at other
 50-1    times as the business of the zone requires.
 50-2          (c)  Notice of the time, place, and purpose of any meeting of
 50-3    the board shall be given by posting a notice containing that
 50-4    information at a place convenient to the public within the
 50-5    development zone.  A copy of the notice shall be furnished to the
 50-6    clerk of the county, who shall post the notice on a bulletin board
 50-7    in the county courthouse used for that purpose.
 50-8          Sec. 376.467.  DIRECTOR'S COMPENSATION; BOND AND OATH OF
 50-9    OFFICE. Sections 375.067, 375.069, and 375.070 apply to directors
50-10    of the development zone as if the zone were a municipal management
50-11    district.
50-12          Sec. 376.468.  GENERAL POWERS. (a)  The development zone may
50-13    acquire and dispose of projects and has the powers, authority,
50-14    rights, and duties that are necessary to permit the accomplishment
50-15    of purposes for which the zone was created.
50-16          (b)  The development zone may provide for general promotion
50-17    of and tourist advertising regarding the zone and its vicinity and
50-18    for a marketing program to attract visitors.  The zone may conduct
50-19    those activities under contracts for professional services with
50-20    persons or organizations the zone selects.
50-21          (c)  The development zone may enter into a memorandum of
50-22    understanding with any state agency, including an institution of
50-23    higher education, to further the economic development of the zone.
50-24          (d)  To the extent not inconsistent with this subchapter, the
50-25    development zone has the powers of:
50-26                (1)  a municipal management district created under
50-27    Chapter 375; and
 51-1                (2)  a county commissioners court under Section
 51-2    381.004.
 51-3          Sec. 376.469.  DUTY TO EVALUATE AVAILABLE FINANCING OPTIONS.
 51-4    The board shall evaluate all options available to the development
 51-5    zone as alternatives to imposing a tax under Section 376.457,
 51-6    including:
 51-7                (1)  regional grants from federal and state agencies;
 51-8                (2)  local money from the county;
 51-9                (3)  money from charities;
51-10                (4)  sales taxes for economic development in the
51-11    development zone;
51-12                (5)  use or impact fees on affected business entities;
51-13                (6)  incentives for business entities that may benefit
51-14    from the development zone;
51-15                (7)  money provided by local governmental entities; and
51-16                (8)  in-kind contributions.
51-17          Sec. 376.470.  LIMIT ON DEVELOPMENT ZONE POWERS; OTHER LAWS
51-18    SUPERSEDE. (a)  For purposes of this section, "district or zone"
51-19    means:
51-20                (1)  a federal enterprise zone;
51-21                (2)  a state enterprise zone;
51-22                (3)  a municipal management district; or
51-23                (4)  any other special district, other than the
51-24    development zone.
51-25          (b)  This section applies only to a district or zone that
51-26    contains territory included in the development zone's territory.
51-27          (c)  The authority granted to the development zone under this
 52-1    subchapter is not intended to duplicate the authority granted to a
 52-2    district or zone.
 52-3          (d)  This subchapter does not limit the authority or
 52-4    jurisdiction of any district or zone.
 52-5          (e)  To the extent this subchapter conflicts with the laws of
 52-6    any other district or zone, the laws of the other district or zone
 52-7    shall control over this subchapter.
 52-8          Sec. 376.471.  MONITORING. (a)  The board shall monitor each
 52-9    person in the development zone that receives benefits available
52-10    under this subchapter.
52-11          (b)  On the board's request, the Texas Workforce Commission
52-12    or the comptroller shall provide to the board tax records of a
52-13    person that receives benefits under this subchapter.
52-14          Sec. 376.472.  NEIGHBORHOOD REDEVELOPMENT ZONES. (a)  The
52-15    board may designate an area as a neighborhood redevelopment zone if
52-16    the area:
52-17                (1)  is adjacent to the development zone;
52-18                (2)  is adjacent to major transportation nodes and
52-19    thoroughfares that may be used for exporting products to major
52-20    airports, railways, and ports; and
52-21                (3)  is an area of pervasive poverty, unemployment, or
52-22    economic distress because:
52-23                      (A)  the average rate of unemployment in the area
52-24    during the most recent 12-month period for which data are available
52-25    was at least 1-1/2 times the state average for that period;
52-26                      (B)  the area is a low-income poverty area;
52-27                      (C)  the area is in a jurisdiction or pocket of
 53-1    poverty, according to the most recent certification available from
 53-2    the United States Department of Housing and Urban Development; or
 53-3                      (D)  at least 70 percent of the residents or
 53-4    households of the area have an income that is less than 80 percent
 53-5    of the median income of the residents or households of the locality
 53-6    or state, whichever is less.
 53-7          (b)  The development zone may exercise the powers available
 53-8    to it in an area designated by the board under Subsection (a).
 53-9          Sec. 376.473. SUITS. The development zone may, through its
53-10    directors, sue and be sued in this state in the name of the
53-11    development zone.  Service of process in a suit may be had by
53-12    serving a director.
53-13          Sec. 376.474.  EXPENDITURES.  The development zone's money
53-14    may be disbursed only by check, draft, order, or other instrument
53-15    signed by at least three directors.  The general manager,
53-16    treasurer, or other employee of the development zone, if authorized
53-17    by resolution of the board, may sign checks, drafts, orders, or
53-18    other instruments on any development zone operation account on
53-19    behalf of the board.
53-20          Sec. 376.475.  COMPETITIVE BIDDING; CONTRACT AWARD.
53-21    Subchapter K, Chapter 375, applies to the development zone as if
53-22    the zone were a municipal management district.
53-23          Sec. 376.476.  DISSOLUTION OF DEVELOPMENT ZONE BY COUNTY.
53-24    (a)  After a hearing, the county may dissolve the development zone
53-25    if:
53-26                (1)  the best interests of the county and the owners of
53-27    property and interests in property in the zone will be served by
 54-1    dissolving the zone; and
 54-2                (2)  the county by order:
 54-3                      (A)  proposes that the zone should be dissolved;
 54-4                      (B)  disposes of zone assets; and
 54-5                      (C)  assumes liabilities of the zone.
 54-6          (b)  The dissolution of the development zone does not affect
 54-7    the validity of a:
 54-8                (1)  tax incentive or regulatory relief granted or
 54-9    accrued before the removal; or
54-10                (2)  bond issued under this subchapter.
54-11          Sec. 376.477.  DISSOLUTION BY BOARD REQUEST.  The board may
54-12    petition the county to dissolve the development zone under Section
54-13    376.476 if a majority of the board finds at any time:
54-14                (1)  before the authorization of bonds or the final
54-15    lending of its credit that the continuation of the development zone
54-16    is impracticable or cannot be successfully and beneficially
54-17    accomplished; or
54-18                (2)  that all bonds of the development zone or other
54-19    debts of the zone have been paid and the purposes of the zone have
54-20    been accomplished.
54-21          Sec. 376.478.  TAXES.  On dissolution of the development
54-22    zone, any taxes levied on behalf of the zone are abolished.
54-23          SECTION 2. Not later than October 1, 2001, the Commissioners
54-24    Court of Harris County shall:
54-25                (1)  summarize the incentives or programs required
54-26    under Section 376.456, Local Government Code, as added by this Act;
54-27    and
 55-1                (2)  appoint directors under Section 376.459, Local
 55-2    Government Code, as added by this Act.
 55-3          SECTION 3.  This Act takes effect immediately if it receives
 55-4    a vote of two-thirds of all the members elected to each house, as
 55-5    provided by Section 39, Article III, Texas Constitution.  If this
 55-6    Act does not receive the vote necessary for immediate effect, this
 55-7    Act takes effect September 1, 2001.
