1-1 AN ACT
1-2 relating to property, facilities, and equipment of the Culberson
1-3 County Hospital District.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Sections 5.06(b)-(d), Chapter 515, Acts of the
1-6 69th Legislature, Regular Session, 1985, are amended to read as
1-7 follows:
1-8 (b) The board may lease or acquire property, facilities, and
1-9 equipment for the use of the district [for use in the hospital
1-10 system] and may mortgage or pledge the property, facilities, or
1-11 equipment [acquired] as security for the payment of the purchase
1-12 price.
1-13 (c) The board may sell, lease, or otherwise dispose of
1-14 property, [hospital] facilities, or equipment on behalf of the
1-15 district. Sale or other disposal of the property, facilities, or
1-16 equipment must be at a public sale and at a price and on the terms
1-17 the board determines are most advantageous to the district.
1-18 (d) The board may donate to another governmental entity or
1-19 to a charitable organization any surplus personal property or
1-20 equipment if the donation serves a public purpose and is
1-21 accompanied by adequate consideration [sell or otherwise dispose of
1-22 property, facilities, or equipment on behalf of the district].
1-23 SECTION 2. This Act takes effect immediately if it receives
1-24 a vote of two-thirds of all the members elected to each house, as
2-1 provided by Section 39, Article III, Texas Constitution. If this
2-2 Act does not receive the vote necessary for immediate effect, this
2-3 Act takes effect September 1, 2001.
