 1-7                            A BILL TO BE ENTITLED
 1-8                                   AN ACT
 1-9     relating to property, facilities, and equipment of the Culberson
1-10     County Hospital District.
1-11           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12           SECTION 1. Sections 5.06(b)-(d), Chapter 515, Acts of the
1-13     69th Legislature, Regular Session, 1985, are amended to read as
1-14     follows:
1-15           (b)  The board may lease or acquire property, facilities, and
1-16     equipment for the use of the district [for use in the hospital
1-17     system] and may mortgage or pledge the property, facilities, or
1-18     equipment [acquired] as security for the payment of the purchase
1-19     price.
1-20           (c)  The board may sell, lease, or otherwise dispose of
1-21     property, [hospital] facilities, or equipment on behalf of the
1-22     district.  Sale or other disposal of the property, facilities, or
1-23     equipment must be at a public sale and at a price and on the terms
1-24     the board determines are most advantageous to the district.
1-25           (d)  The board may donate to another governmental entity or
1-26     to a charitable organization any surplus personal property or
1-27     equipment if the donation serves a public purpose and is
1-28     accompanied by adequate consideration [sell or otherwise dispose of
1-29     property, facilities, or equipment on behalf of the district].
1-30           SECTION 2.  This Act takes effect immediately if it receives
1-31     a vote of two-thirds of all the members elected to each house, as
1-32     provided by Section 39, Article III, Texas Constitution.  If this
1-33     Act does not receive the vote necessary for immediate effect, this
1-34     Act takes effect September 1, 2001.
