No. 1592 1-2 (Senate Sponsor - Van de Putte) 1-3 (In the Senate - Received from the House April 30, 2001; 1-4 April 30, 2001, read first time and referred to Committee on 1-5 Business and Commerce; May 10, 2001, reported favorably by the 1-6 following vote: Yeas 7, Nays 0; May 10, 2001, sent to printer.) 1-7 A BILL TO BE ENTITLED 1-8 AN ACT 1-9 relating to a project of an industrial development corporation. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Section 2(11)(A), Development Corporation Act of 1-12 1979 (Article 5190.6, Vernon's Texas Civil Statutes), is amended 1-13 to read as follows: 1-14 (A) "Project" shall mean the land, buildings, 1-15 equipment, facilities, targeted infrastructure, and improvements 1-16 (one or more) to promote new and expanded business development or 1-17 found by the board of directors to be required or suitable for the 1-18 promotion of development and expansion of manufacturing and 1-19 industrial facilities, job creation and retention, job training, 1-20 educational facilities, research and development facilities, 1-21 transportation facilities (including but not limited to airports, 1-22 ports, mass commuting facilities, and parking facilities), sewage 1-23 or solid waste disposal facilities, recycling facilities, air or 1-24 water pollution control facilities, facilities for the furnishing 1-25 of water to the general public, distribution centers, small 1-26 warehouse facilities capable of serving as decentralized storage 1-27 and distribution centers, and facilities for use by institutions of 1-28 higher education, and for the promotion of development or 1-29 redevelopment and expansion, including costs of administration and 1-30 operation, of a military base closed or realigned pursuant to 1-31 recommendation of the Defense Closure and Realignment Commission 1-32 pursuant to the Defense Base Closure and Realignment Act of 1990 1-33 (10 U.S.C. Section 2687 note) as amended, and of facilities which 1-34 are related to any of the foregoing, and in furtherance of the 1-35 public purposes of this Act, all as defined in the rules of the 1-36 department, irrespective of whether in existence or required to be 1-37 identified, acquired, or constructed thereafter. 1-38 "Project" also includes job training required or suitable for 1-39 the promotion of development and expansion of business enterprises 1-40 and other enterprises described by this Act, as provided by Section 1-41 38 of this Act. 1-42 SECTION 2. This Act takes effect immediately if it receives 1-43 a vote of two-thirds of all the members elected to each house, as 1-44 provided by Section 39, Article III, Texas Constitution. If this 1-45 Act does not receive the vote necessary for immediate effect, this 1-46 Act takes effect September 1, 2001. 1-47 * * * * *
