                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to suspending crime victims' compensation payments
 1-3     otherwise paid to a person imprisoned in the institutional division
 1-4     of the Texas Department of Criminal Justice.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1. Chapter 42, Code of Criminal Procedure, is amended
 1-7     by adding Article 42.025 to read as follows:
 1-8           Art. 42.025.  SUSPENSION OF CRIME VICTIMS' COMPENSATION TO
 1-9     INMATES.  On sentencing a person to a term of imprisonment in the
1-10     institutional division of the Texas Department of Criminal Justice,
1-11     the court shall inform the person of the consequence of the
1-12     sentence imposed as it relates to the person's eligibility to
1-13     receive crime victims' compensation payments under Subchapter B,
1-14     Chapter 56.
1-15           SECTION 2. Article 56.44, Code of Criminal Procedure, is
1-16     amended by adding Subsection (e) to read as follows:
1-17           (e)  A person convicted of an offense and sentenced to a term
1-18     of imprisonment in the institutional division of the Texas
1-19     Department of Criminal Justice who was eligible for and receiving
1-20     compensation as a victim or claimant on the date the person began
1-21     serving the sentence may not receive a payment under this
1-22     subchapter until the date the person discharges the sentence or is
1-23     released on parole or mandatory supervision.
1-24           SECTION 3. The change in law made by this Act applies only to
 2-1     a person convicted of an offense committed on or after the
 2-2     effective date of this Act.  A person convicted of an offense
 2-3     committed before the effective date of this Act is covered by the
 2-4     law in effect when the offense was committed, and the former law is
 2-5     continued in effect for that purpose.  For purposes of this
 2-6     section, an offense was committed before the effective date of this
 2-7     Act if any element of the offense occurred before that date.
 2-8           SECTION 4. This Act takes effect September 1, 2001.
