No. 1628 77R6903 T A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the conveyance of certain state property located in 1-3 Jefferson County. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. (a) The Texas Department of Mental Health and 1-6 Mental Retardation may convey, on behalf of the state, all or any 1-7 portion of the state's interest in the real property, including the 1-8 land and all improvements affixed to the land, described by 1-9 subsections (d) of this section to Spindletop MHMR Services for use 1-10 as a facility to provide community-based mental health and mental 1-11 retardation services. 1-12 (b) Any and all effective restrictive conditions on the 1-13 various parcels of land as set forth in deeds to the state and in 1-14 the Deed Records of Jefferson County run with the land and are 1-15 binding on the Spindletop MHMR Services. 1-16 (c) The Texas Department of Mental Health and Mental 1-17 Retardation shall convey the property by a deed without warranties. 1-18 The instrument must include a provision that: 1-19 (1) Indicates that the restrictive conditions referred 1-20 to in subsection (b) of this section are binding on Spindletop MHMR 1-21 Services; and 1-22 (2) Requires the property to be continuously used for 1-23 mental health and/or mental retardation purposes; and 1-24 (3) Requires that the property shall automatically 2-1 revert to the State of Texas for the use and benefit of TDMHMR if 2-2 any of the restrictive conditions are continuously breached for a 2-3 period of 180 days. 2-4 (d) The property to be conveyed consists of the former site 2-5 of the Beaumont State Center situated primarily at 655 South 8th 2-6 Street, Beaumont, Texas, which is comprised of three contiguous 2-7 parcels, collectively constituting +/- 13.085 acres of land; an 2-8 adjacent parcel of +/- 1.961 acres; and a single parcel in Port 2-9 Arthur constituting +/- 2.7614, as set forth below; 2-10 (1)(i) +/- 2.181 acre tract of land out of the David 2-11 Brown Survey, Jefferson County, Texas, and more 2-12 particularly described as Tract 72 B by metes and 2-13 bounds in a deed to the state recorded at Volume 1465, 2-14 Page 455, of the Deed Records of Jefferson County; 2-15 (ii) +/- 1.09 acre tract of land out the David Brown 2-16 Survey, Jefferson County, Texas and more particularly 2-17 described as Tract 73 by metes and bounds in that 2-18 Beaumont City Ordinance of May 10th, 1966, and recorded 2-19 as file 713511 in the Deed Records of Jefferson County; 2-20 (iii) +/- 9.814 acre tract of land out of the David 2-21 Brown Survey, Jefferson County, Texas and more 2-22 particularly described as Tract 73 A by metes and 2-23 bounds in a deed to the state recorded at Volume 1830, 2-24 Page 1, of the Deed Records of Jefferson County; 2-25 (2) +/- 1.961 acre tract of land out of the Noah Tevis 2-26 League in Beaumont, Jefferson County, Texas and more 2-27 particularly described as Tract 66 by metes and bounds 3-1 in a deed to the state recorded at Volume 2271, Page 3-2 133, of the Deed Records of Jefferson County; and 3-3 (3) +/- 2.7614 acre tract of land out of Lot 6, Block 3-4 9, Range 1 of the Port Arthur Land Company Subdivision, 3-5 Jefferson County, Texas, and being a part of that +/- 3-6 6.06 acre tract recorded as file 8332212 of the deed 3-7 records of Jefferson County and more particularly 3-8 described by metes and bounds in that Partition 3-9 Agreement of August 26, 1991, between Mental 3-10 Health - Mental Retardation of Southeast Texas/Life 3-11 Resources, Inc., the Texas Department of Mental Health 3-12 and Mental Retardation, and Jefferson County, and 3-13 recorded as file 9129306 of Deed Records of Jefferson 3-14 County. 3-15 SECTION 2. The state reserves its property interest in all 3-16 oil, gas, and other minerals in and under the land conveyed as 3-17 authorized by this Act and the right and power to remove any and 3-18 all of the oil, gas, and minerals, including any right and power to 3-19 grant oil, gas, and mineral leases held by the state before the 3-20 conveyance of the property described by this Act. 3-21 SECTION 3. Sections 31.1571 and 31.158, Natural Resources 3-22 Code, and Sections 533.084 and 533.087, Health and Safety Code, 3-23 shall not apply to the conveyances authorized by this Act. 3-24 SECTION 4. Nothing in this Act shall be construed to convey 3-25 state debt, if any, to the recipient of the conveyed property. 3-26 SECTION 5. This Act takes effect immediately.
