 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to the use of certain transferred freshmen-level credit
1-11     courses to satisfy the requirements of the Texas Academic Skills
1-12     Program.
1-13           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-14           SECTION 1.  Section 51.306, Education Code, is amended by
1-15     adding Subsection (x) to read as follows:
1-16           (x)  This subsection applies to an undergraduate student who
1-17     transfers to an institution of higher education from an accredited
1-18     private or independent institution of higher education or an
1-19     accredited out-of-state institution of higher education.  A
1-20     transfer student is exempt from the requirements of this section if
1-21     in each of the three skill areas described by Subsection (b) the
1-22     student has earned a grade of "B" or better in a transferred
1-23     freshman-level credit course included in the list of courses
1-24     established by the board under Subsection (g).  A transfer student
1-25     who has not earned a grade of "B" or better in a course in each
1-26     skill area as described by this subsection is subject to the
1-27     requirements of this section for any skill area in which the
1-28     requisite grade was not earned.  A transferred course may not be
1-29     considered for purposes of this subsection unless the transfer
1-30     student submits to the institution of higher education a transcript
1-31     reflecting the grade earned in the course.
1-32           SECTION 2.  The change in law made by this Act applies only
1-33     to a transfer student who enrolls at a public institution of higher
1-34     education for a semester or summer session that begins on or after
1-35     the effective date of this Act.
1-36           SECTION 3.  This Act takes effect immediately if it receives
1-37     a vote of two-thirds of all the members elected to each house, as
1-38     provided by Section 39, Article III, Texas Constitution.  If this
1-39     Act does not receive the vote necessary for immediate effect, this
1-40     Act takes effect September 1, 2001.
