1-1                                   AN ACT
 1-2     relating to the duty of a county to notify the Texas Department of
 1-3     Criminal Justice regarding certain dismissals of criminal cases.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 8, Article 42.09, Code of Criminal
 1-6     Procedure, is amended by adding Subsection (j) to read as follows:
 1-7           (j)  If after a county transfers a defendant or inmate to the
 1-8     Texas Department of Criminal Justice the charges on which the
 1-9     defendant or inmate was convicted and for which the defendant or
1-10     inmate was transferred are dismissed, the county shall immediately
1-11     notify an officer designated by the department of the dismissal.
1-12           SECTION 2.  This Act takes effect immediately if it receives
1-13     a vote of two-thirds of all the members elected to each house, as
1-14     provided by Section 39, Article III, Texas Constitution.  If this
1-15     Act does not receive the vote necessary for immediate effect, this
1-16     Act takes effect September 1, 2001.
