                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the fine or penalty for the violation of a rule,
 1-3     ordinance, or police regulation governing certain offenses in
 1-4     certain municipalities.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1. Section 54.001(b), Local Government Code, is
 1-7     amended to read as follows:
 1-8           (b)  A fine or penalty for the violation of a rule,
 1-9     ordinance, or police regulation may not exceed $500.  However:
1-10                 (1)  [,] a fine or penalty for the violation of a rule,
1-11     ordinance, or police regulation that governs fire safety, zoning,
1-12     or public health and sanitation, including dumping of refuse, may
1-13     not exceed $2,000; or
1-14                 (2)  a fine or penalty for the violation of a rule,
1-15     ordinance, or police regulation that is adopted by a municipality
1-16     with a population of 1.9 million or more and that governs municipal
1-17     beautification may not exceed $2,000.
1-18           SECTION 2. This Act takes effect September 1, 2001, and the
1-19     change in law made by this Act applies only to the violation of a
1-20     rule, ordinance, or police regulation committed on or after that
1-21     date. The violation of a rule, ordinance, or police regulation
1-22     committed before the effective date of this Act is covered by the
1-23     law in effect when the violation was committed, and the former law
1-24     is continued in effect for that purpose. For purposes of this
 2-1     section, a violation was committed before the effective date of
 2-2     this Act if any element of the violation occurred before that date.
