No. 1662 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the automatic location identification system along 1-3 state highways. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Chapter 771, Health and Safety Code, is amended by 1-6 adding Subchapter E to read as follows: 1-7 SUBCHAPTER E. AUTOMATIC LOCATION IDENTIFICATION SYSTEM 1-8 Sec. 771.101. DEFINITION. In this subchapter, "emergency 1-9 response services" means: 1-10 (1) fire-fighting, law enforcement, or emergency 1-11 medical services that are provided by a public agency; or 1-12 (2) motorist assistance services. 1-13 Sec. 771.102. INSTALLATION, OPERATION, AND MAINTENANCE OF 1-14 AUTOMATIC LOCATION IDENTIFICATION SYSTEM. (a) The commission may 1-15 provide for the installation, operation, and maintenance of a 1-16 system of automatic location identification telephone call boxes 1-17 along those highways in this state that are part of the designated 1-18 state highway system. A system implemented by the commission must 1-19 begin along rural interstate highways, including rest stops and 1-20 roadside parks. 1-21 (b) A system implemented by the commission may: 1-22 (1) be designed to enable users of those highways to 1-23 communicate with providers of emergency and nonemergency response 1-24 services; 2-1 (2) include: 2-2 (A) wired or wireless telecommunications 2-3 services; and 2-4 (B) one or more motorist assistance answering 2-5 centers; and 2-6 (3) be capable of performing compatible Intelligent 2-7 Transportation System (ITS) functions. 2-8 (c) To minimize call processing loads in public safety 2-9 answering points established under this subchapter or Chapter 772, 2-10 the commission may contract with a private entity to perform the 2-11 functions of a motorist assistance answering center under 2-12 Subsection (b)(2)(B). 2-13 Sec. 771.103. DISTANCE BETWEEN AUTOMATIC LOCATION 2-14 IDENTIFICATION SYSTEM CALL BOXES. If the commission implements the 2-15 system, the distance between two automatic location identification 2-16 system call boxes may not exceed two miles, except as prohibited by 2-17 roadway conditions or where 24-hour communication service exists. 2-18 Sec. 771.104. FUNDING. (a) The commission shall implement 2-19 the automatic location identification system in accordance with the 2-20 General Appropriations Act. 2-21 (b) Revenue derived from fees, taxes, or other charges 2-22 imposed in connection with the sale or provision of services by 2-23 means of landline or wireless telecommunications infrastructure, 2-24 other than sales taxes imposed on taxable services, as defined by 2-25 Section 151.0101, Tax Code, may not be appropriated or used for the 2-26 implementation of the automatic location identification system. 2-27 (c) In implementing the automatic location identification 3-1 system, the commission may not spend money that is constitutionally 3-2 dedicated for another purpose. 3-3 Sec. 771.105. TECHNICAL ASSISTANCE FROM COMMISSION. The 3-4 commission shall provide technical assistance, including things 3-5 necessary to support the proper routing of a call made to an 3-6 emergency response services provider from an automatic location 3-7 identification call box and any emergency response to that call. 3-8 Sec. 771.106. INTERGOVERNMENTAL COOPERATION. Agencies of 3-9 this state and each county and municipality in this state shall 3-10 cooperate with the commission in the design, establishment, 3-11 operation, and maintenance of an automatic location identification 3-12 system implemented by the commission. 3-13 Sec. 771.107. CONTRACTS FOR IMPLEMENTATION AND INSTALLATION 3-14 OF AUTOMATIC LOCATION IDENTIFICATION SYSTEM. (a) If the commission 3-15 elects to implement the system, the commission shall attempt to: 3-16 (1) award one or more contracts to implement the 3-17 system not later than June 1, 2002; and 3-18 (2) require that installation of the system begin not 3-19 later than September 1, 2002. 3-20 (b) A contract awarded under this subchapter shall be 3-21 awarded by the commission in the manner otherwise provided by law. 3-22 (c) The commission may solicit proposals for and enter into 3-23 one or more lease-purchase agreements under this subchapter. 3-24 Sec. 771.108. ANNUAL REPORTS. (a) Not later than November 1 3-25 of each year, the commission shall file with the lieutenant 3-26 governor, the speaker of the house of representatives, and the 3-27 Legislative Budget Board a report on the activities under this 4-1 subchapter during the preceding fiscal year. 4-2 (b) The report may include the commission's recommendations 4-3 for action by the legislature. 4-4 SECTION 2. Chapter 226, Transportation Code, is repealed. 4-5 SECTION 3. This Act takes effect September 1, 2001.
