By Ellis H.B. No. 1697 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the erection and maintenance of outdoor advertising by 1-3 certain nonprofit organizations or schools. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter B, Chapter 391, Transportation Code, is 1-6 amended by adding Section 391.037 to read as follows: 1-7 Sec. 391.037. OUTDOOR ADVERTISING BY CERTAIN COUNTY 1-8 AGRICULTURAL FAIRS. Outdoor advertising that is an outdoor sign may 1-9 include the logo or emblem of an entity if: 1-10 (1) the sign is erected or maintained by: 1-11 (A) a nonprofit county agricultural fair; 1-12 (B) a public or private elementary or secondary 1-13 school; or 1-14 (C) a public or private institution of higher 1-15 education; 1-16 (2) the entity sponsors or provides significant 1-17 funding to the agricultural fair, school, or institution of higher 1-18 education; and 1-19 (3) the entity's logo or emblem occupies less than 25 1-20 percent of the area of the sign. 1-21 SECTION 2. This Act takes effect immediately if it receives 1-22 a vote of two-thirds of all the members elected to each house, as 1-23 provided by Section 39, Article III, Texas Constitution. If this 1-24 Act does not receive the vote necessary for immediate effect, this 2-1 Act takes effect September 1, 2001.
