1-1 AN ACT
1-2 relating to the erection and maintenance of outdoor advertising by
1-3 certain nonprofit organizations or schools.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Subchapter B, Chapter 391, Transportation Code, is
1-6 amended by adding Section 391.037 to read as follows:
1-7 Sec. 391.037. OUTDOOR ADVERTISING BY CERTAIN COUNTY
1-8 AGRICULTURAL FAIRS. Outdoor advertising that is an outdoor sign may
1-9 include the logo or emblem of an entity if:
1-10 (1) the sign is erected or maintained by:
1-11 (A) a nonprofit county agricultural fair;
1-12 (B) a public or private elementary or secondary
1-13 school; or
1-14 (C) a public or private institution of higher
1-15 education;
1-16 (2) the sign is erected or maintained in a county with
1-17 a population of 65,000 or less;
1-18 (3) the entity sponsors or provides significant
1-19 funding to the agricultural fair, school, or institution of higher
1-20 education; and
1-21 (4) the entity's logo or emblem occupies less than 25
1-22 percent of the area of the sign.
1-23 SECTION 2. This Act takes effect immediately if it receives
1-24 a vote of two-thirds of all the members elected to each house, as
2-1 provided by Section 39, Article III, Texas Constitution. If this
2-2 Act does not receive the vote necessary for immediate effect, this
2-3 Act takes effect September 1, 2001.
