No. 1697 1-2 (In the Senate - Received from the House May 2, 2001; 1-3 May 3, 2001, read first time and referred to Committee on State 1-4 Affairs; May 11, 2001, reported favorably by the following vote: 1-5 Yeas 5, Nays 0; May 11, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the erection and maintenance of outdoor advertising by 1-9 certain nonprofit organizations or schools. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Subchapter B, Chapter 391, Transportation Code, is 1-12 amended by adding Section 391.037 to read as follows: 1-13 Sec. 391.037. OUTDOOR ADVERTISING BY CERTAIN COUNTY 1-14 AGRICULTURAL FAIRS. Outdoor advertising that is an outdoor sign may 1-15 include the logo or emblem of an entity if: 1-16 (1) the sign is erected or maintained by: 1-17 (A) a nonprofit county agricultural fair; 1-18 (B) a public or private elementary or secondary 1-19 school; or 1-20 (C) a public or private institution of higher 1-21 education; 1-22 (2) the entity sponsors or provides significant 1-23 funding to the agricultural fair, school, or institution of higher 1-24 education; and 1-25 (3) the entity's logo or emblem occupies less than 25 1-26 percent of the area of the sign. 1-27 SECTION 2. This Act takes effect immediately if it receives 1-28 a vote of two-thirds of all the members elected to each house, as 1-29 provided by Section 39, Article III, Texas Constitution. If this 1-30 Act does not receive the vote necessary for immediate effect, this 1-31 Act takes effect September 1, 2001. 1-32 * * * * *
