                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to a requirement that school district nurses and
 1-3     counselors provide information and assistance concerning student
 1-4     enrollment in the state child health plan.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Chapter 38, Education Code, is amended by adding
 1-7     Section 38.013 to read as follows:
 1-8           Sec. 38.013.  INFORMATION AND ASSISTANCE CONCERNING THE
 1-9     STATE CHILD HEALTH PLAN.  (a)  The board of trustees of each school
1-10     district shall adopt procedures under which school counselors and
1-11     nurses shall:
1-12                 (1)  inform appropriate students and their parents of
1-13     the availability of health benefits coverage under the state child
1-14     health plan authorized by Chapter 62, Health and Safety Code; and
1-15                 (2)  on request of a student or the student's parent,
1-16     assist the student or parent in applying for coverage for the
1-17     student under that plan.
1-18           (b)  In this section, "parent" includes a person standing in
1-19     parental relation.
1-20           SECTION 2.  Not later than January 1, 2002, in accordance
1-21     with Section 38.013, Education Code, as added by this Act, the
1-22     board of trustees of each school district shall adopt procedures
1-23     under which school nurses and counselors provide information and
1-24     assistance concerning the state child health plan.
 2-1           SECTION 3.  This Act takes effect immediately if it receives
 2-2     a vote of two-thirds of all the members elected to each house, as
 2-3     provided by Section 39, Article III, Texas Constitution.  If this
 2-4     Act does not receive the vote necessary for immediate effect, this
 2-5     Act takes effect September 1, 2001.
