                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the definition of "sexual contact" for purposes of
 1-3     certain sex offenses.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 21.01(2), Penal Code, is amended to read
 1-6     as follows:
 1-7                 (2)  "Sexual contact" means any touching of:
 1-8                       (A)  the anus, breast, or any part of the
 1-9     genitals of another person with intent to arouse or gratify the
1-10     sexual desire of any person; or
1-11                       (B)  any part of another person's body with the
1-12     actor's anus or breast or any part of the actor's genitals with
1-13     intent to arouse or gratify the sexual desire of any person.
1-14           SECTION 2. The change in law made by this Act applies only to
1-15     an offense committed on or after the effective date of this Act. An
1-16     offense committed before the effective date of this Act is covered
1-17     by the law in effect when the offense was committed, and the former
1-18     law is continued in effect for that purpose.  For purposes of this
1-19     section, an offense was committed before the effective date of this
1-20     Act if any element of the offense occurred before that date.
1-21           SECTION 3. This Act takes effect September 1, 2001.
