                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to discharging fines and costs in a criminal case by
 1-3     performing community service.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Article 43.09(k), Code of Criminal Procedure, is
 1-6     amended to read as follows:
 1-7           (k)  A defendant is considered to have discharged, as
 1-8     specified by the court, not less than $50 or more than $100 of
 1-9     fines or costs for each eight hours of community service performed
1-10     under Subsection (f) of this article.
1-11           SECTION 2. (a)  The change in law made by this Act applies
1-12     only to a defendant convicted of an offense committed on or after
1-13     the effective date of this Act.  For purposes of this section, an
1-14     offense is committed before the effective date of this Act if any
1-15     element of the offense occurs before the effective date.
1-16           (b)  A defendant convicted of an offense committed before the
1-17     effective date of this Act is covered by the law in effect when the
1-18     offense was committed, and the former law is continued in effect
1-19     for that purpose.
1-20           SECTION 3. This Act takes effect September 1, 2001.
