                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the authority of the Tarrant Regional Water District, A
 1-3     Water Control and Improvement District, to generate and purchase
 1-4     water power and electric energy and to acquire and dispose of
 1-5     facilities for those purposes.
 1-6           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-7           SECTION 1. Chapter 340, Acts of the 51st Legislature, Regular
 1-8     Session, 1949 (Article 8280-207, Vernon's Texas Civil Statutes), is
 1-9     amended by adding Article 8280-207(c) to read as follows:
1-10           SECTION 1.  The District, in addition to any other powers
1-11     granted by law, may:
1-12           (a)  develop, generate, transmit, or distribute water power
1-13     and electric energy within the District's service area for its own
1-14     use;
1-15           (b)  purchase electric energy from any available source for
1-16     use at a facility the District owns, operates, or maintains within
1-17     the District's service area irrespective of whether customer choice
1-18     as defined by Section 31.002(4) of the Texas Utilities Code is
1-19     offered in the area in which the District's facility is located;
1-20           (c)  acquire, install, construct, finance, operate, make an
1-21     addition to, own, or operate an electric energy generating,
1-22     transmission, or distribution facility or enter into an agreement
1-23     to jointly do so with another person; or
1-24           (d)  sell or otherwise dispose of any of the District's
 2-1     interest in a jointly owned facility described by Subsection (c) of
 2-2     this section.
 2-3           SECTION 2.  The District's service area is defined as any
 2-4     territory in which the District has facilities for the storage,
 2-5     conveyance, or distribution of water.
 2-6           SECTION 3.  This Act does not affect the applicability of
 2-7     Title 2, Utilities Code, to the District or to actions of the
 2-8     District.
 2-9           SECTION 2.  This Act takes effect January 1, 2002.
