                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the frequency of municipal bond elections.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Chapter 1251, Government Code, is amended by
 1-5     adding Section 1251.007 to read as follows:
 1-6           Sec. 1251.007.  FREQUENCY OF BOND ELECTIONS.  (a)  In this
 1-7     section, "political subdivision" means a:
 1-8                 (1)  county;
 1-9                 (2)  municipality;
1-10                 (3)  school district;
1-11                 (4)  junior college district;
1-12                 (5)  district or authority created under Article III,
1-13     Section 52, or Article XVI, Section 59, Texas Constitution; or
1-14                 (6)  any other special purpose district that has taxing
1-15     authority.
1-16           (b)  A political subdivision may not call an election on a
1-17     bond proposal that failed at an earlier election or on a bond
1-18     proposal that is similar or related to the earlier bond proposal
1-19     before the first anniversary of the date of the election at which
1-20     the earlier bond proposal failed.
1-21           (c)  The authority responsible for ordering the election on a
1-22     bond proposal shall determine whether the bond proposal is the same
1-23     as or similar or related to a bond proposal that failed at an
1-24     election held within the 12 months preceding the date proposed for
 2-1     the election on the new bond proposal.
 2-2           SECTION 2.  This Act takes effect September 1, 2001.
