                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the creation, administration, powers, duties,
 1-3     operation, and financing of the West Harris County Regional Water
 1-4     Authority; granting the power of eminent domain; granting the
 1-5     authority to issue bonds or notes; providing a civil penalty.
 1-6           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-7                       ARTICLE 1.  GENERAL PROVISIONS
 1-8           SECTION 1.01.  CREATION. (a)  A regional water authority, to
 1-9     be known as the West Harris County Regional Water Authority, is
1-10     created in Harris County.  The authority is a political subdivision
1-11     of this state, a governmental agency, and a body politic and
1-12     corporate.
1-13           (b)  The authority is created under and is essential to
1-14     accomplish the purposes of Section 59, Article XVI, Texas
1-15     Constitution, including the acquisition and provision of surface
1-16     water and groundwater for residential, commercial, industrial,
1-17     agricultural, and other uses, the reduction of groundwater
1-18     withdrawals, the conservation, preservation, protection, recharge,
1-19     and prevention of waste of groundwater, and of groundwater
1-20     reservoirs or their subdivisions, the control of subsidence caused
1-21     by withdrawal of water from those groundwater reservoirs or their
1-22     subdivisions, and other public purposes stated in this Act.
1-23           SECTION 1.02.  DEFINITIONS. In this Act:
1-24                 (1)  "Authority" means the West Harris County Regional
 2-1     Water Authority.
 2-2                 (2)  "Board" means the board of directors of the
 2-3     authority.
 2-4                 (3)  "Commission" means the Texas Natural Resource
 2-5     Conservation Commission, or its successor.
 2-6                 (4)  "Director" means a member of the board.
 2-7                 (5)  "District" means any district created under
 2-8     Sections 52(b)(1) and (2), Article III, or Section 59, Article XVI,
 2-9     Texas Constitution, regardless of the manner of creation, other
2-10     than:
2-11                       (A)  a navigation district or port authority; or
2-12                       (B)  a district governed by Chapter 36, Water
2-13     Code.
2-14                 (6)  "Groundwater reduction plan" means a plan adopted
2-15     or implemented to supply water, reduce reliance on groundwater,
2-16     regulate groundwater pumping and usage, or require and allocate
2-17     water usage among persons in order to comply with or exceed
2-18     requirements imposed by the subsidence district, including any
2-19     applicable groundwater reduction requirements.
2-20                 (7)  "Local government" means a municipality, county,
2-21     district, or other political subdivision of this state or a
2-22     combination of two or more of those entities.
2-23                 (8)  "Person" includes an individual, corporation,
2-24     organization, government or governmental subdivision or agency,
2-25     district, local government, business trust, estate, trust,
2-26     partnership, association, or any other legal entity.
2-27                 (9)  "Subsidence" has the meaning assigned by Section
 3-1     151.002, Water Code.
 3-2                 (10)  "Subsidence district" means the Harris-Galveston
 3-3     Coastal Subsidence District.
 3-4                 (11)  "System" means a network of pipelines, conduits,
 3-5     valves, canals, pumping stations, force mains, treatment plants,
 3-6     and any other construction, device, or related appurtenance used to
 3-7     treat or transport water.
 3-8                 (12)  "Water" includes:
 3-9                       (A)  groundwater, percolating or otherwise;
3-10                       (B)  any surface water, natural or artificial,
3-11     navigable or nonnavigable; and
3-12                       (C)  industrial and municipal wastewater.
3-13                 (13)  "Well" includes a facility, device, or method
3-14     used to withdraw groundwater from a groundwater source within the
3-15     boundaries of the authority.
3-16           SECTION 1.03.  DESCRIPTION OF BOUNDARIES. (a)  The authority
3-17     includes the territory that is contained in the following area,
3-18     regardless of whether the territory contains noncontiguous parcels
3-19     of land or whether the territory is located within the boundaries
3-20     of any other governmental entity or political subdivision of the
3-21     state:
3-22     TRACT-1
3-23     BEGINNING at the intersection of the easterly right-of-way of
3-24     Kickapoo Road with the northerly line of U. S. Highway 290
3-25     (Hempstead Highway);
3-26     THENCE, southeasterly along the northerly line of U. S. Highway 290
3-27     to its intersection with the easterly right-of-way line of
 4-1     Brittmore Road;
 4-2     THENCE, generally along the current City of Houston corporate
 4-3     limits the following:
 4-4           southerly along the easterly right-of-way line of Brittmore
 4-5     Road to its intersection with the northerly right-of-way line of
 4-6     West Little York Road;
 4-7           easterly along the northerly right-of-way line of West Little
 4-8     York Road to its intersection with the most easterly westerly
 4-9     boundary of the former Northwest Harris County MUD 25 as it existed
4-10     on December 4, 1996;
4-11     southerly along the most easterly westerly boundary of the former
4-12     Northwest Harris County MUD 25 to the most southerly  southerly
4-13     boundary of the former Northwest Harris County MUD 25 as it existed
4-14     on December 4, 1996;
4-15           easterly along the most southerly southerly boundary of the
4-16     former Northwest Harris County MUD 25 as it existed on December 4,
4-17     1996 to the westerly right-of-way line of the West Sam Houston
4-18     Parkway North;
4-19           southerly along the westerly right-of-way line of the West
4-20     Sam Houston Parkway North to the    southerly line of the E.
4-21     Friedenhaus Survey, Abstract 1185;
4-22           westerly along the southerly line of the E. Friedenhaus
4-23     Survey, Abstract 1185 to the southwest corner of said survey, same
4-24     being the northeast corner of the W. C. R. R. Survey, Abstract 917;
4-25           southerly along the westerly line of the W. C. R. R. Survey,
4-26     Abstract 917 to the northeasterly corner of a 29.9426 acre tract

24-23    territory described by Subsection (a) of this section, regardless
24-24    of whether the territory contains noncontiguous parcels of land.
24-25          (c)  Notwithstanding Subsections (a) and (b) of this section,
24-26    the authority does not include any area that, on the effective date
24-27    of this Act, is inside:
 25-1                (1)  the municipal limits of the City of Houston;
 25-2                (2)  the municipal limits or extraterritorial
 25-3    jurisdiction, as determined under Subchapter B, Chapter 42, Local
 25-4    Government Code, of the City of Jersey Village;
 25-5                (3)  the territory of the North Harris County Regional
 25-6    Water Authority; or
 25-7                (4)  the boundaries of Waller County.
 25-8          (d)  All of the territory of a local government created after
 25-9    the effective date of this Act that encompasses any territory
25-10    within the boundaries of the authority, immediately on the creation
25-11    and any necessary confirmation election, and without any action
25-12    required of the authority, is subject to all of the rights, powers,
25-13    privileges, and rules of the authority, to the same extent as the
25-14    territory was before the local government was created.
25-15          SECTION 1.04.  FINDINGS RELATIVE TO BOUNDARIES. The
25-16    legislature finds that the boundaries and field notes of the
25-17    authority form a closure.  If a mistake is made in the field notes
25-18    or in copying the field notes in the legislative process, it does
25-19    not affect the authority's:
25-20                (1)  organization, existence, or validity;
25-21                (2)  right to issue any type of bond or note for the
25-22    purposes for which the authority is created or to pay the principal
25-23    of and interest on a bond or note;
25-24                (3)  right to impose or collect a fee, user fee, rate,
25-25    charge, or special assessment; or
25-26                (4)  legality or operation.
25-27          SECTION 1.05.  EXCLUSION OF CERTAIN TERRITORY. (a)  A
 26-1    district or municipality that, on the effective date of this Act,
 26-2    is located, wholly or partly, within the territory described by
 26-3    Section 1.03(a) or (b) of this Act may petition for exclusion of
 26-4    all of its territory from the authority's boundaries by a petition
 26-5    signed by a majority of the governing body of the district or
 26-6    municipality.  The board shall:
 26-7                (1)  not later than February 28, 2002, grant the
 26-8    petition and order the territory excluded if the petition:
 26-9                      (A)  includes an accurate legal description of
26-10    the boundaries of the territory to be excluded; and
26-11                      (B)  is filed with the authority before December
26-12    31, 2001; and
26-13                (2)  if the board grants the petition, file for
26-14    recording in the office of the county clerk for the applicable
26-15    county or counties a copy of the order and a description of the
26-16    authority's boundaries as they exist after the exclusion of the
26-17    territory.
26-18          (b)  If a district or municipality is excluded from the
26-19    authority's boundaries under this section, the authority:
26-20                (1)  is not required to provide water or any other
26-21    service to the district or municipality; and
26-22                (2)  is not required to include the district or
26-23    municipality in any groundwater reduction plan adopted or
26-24    implemented by the authority.
26-25          (c)  If, before December 31, 2001, a district or municipality
26-26    files a petition for exclusion under this section, the authority
26-27    may not impose fees, user fees, rates, charges, or special
 27-1    assessments on the district or municipality after the petition is
 27-2    filed with and received by the authority unless the district or
 27-3    municipality is annexed by the authority under Section 1.06.
 27-4          (d)  If a district or municipality excluded from the
 27-5    authority's boundaries under this section petitions the authority
 27-6    to be annexed under Section 1.06 of this Act, the authority may
 27-7    annex the district or municipality.  The authority may, as a
 27-8    condition of annexation, require terms and conditions the board
 27-9    considers appropriate.  The authority may require the district or
27-10    municipality to pay the authority the fees, user fees, charges, and
27-11    special assessments, with interest, that, as determined by the
27-12    authority, the district or municipality would have been charged by
27-13    the authority if the district or municipality had not been excluded
27-14    from the authority under this section.
27-15          SECTION 1.06.  ANNEXATION. (a)  Except to the extent the
27-16    authority agrees in writing, a municipality's annexation of
27-17    territory within the authority has no effect on:
27-18                (1)  the authority's powers inside or outside the
27-19    annexed territory;
27-20                (2)  the authority's boundaries or contracts; and
27-21                (3)  the authority's ability to assess fees, user fees,
27-22    rates, charges, or special assessments inside or outside the
27-23    territory annexed by the municipality.
27-24          (b)  Territory may be annexed to the authority, regardless of
27-25    whether the territory is contiguous to the authority, as provided
27-26    by Chapter 49, Water Code.
27-27          (c)  In addition to the authority granted by Subsection (b)
 28-1    of this section, regardless of whether the territory is contiguous
 28-2    to the authority, the authority may annex territory located within
 28-3    a district or municipality if the district or municipality files
 28-4    with the authority a petition requesting the annexation signed by a
 28-5    majority of the governing body of the district or municipality.
 28-6    The petition must include an accurate legal description of the
 28-7    boundaries of the territory to be included.  If the authority has
 28-8    bonds, notes, or other obligations outstanding, the authority shall
 28-9    require the petitioning district or municipality to be obligated to
28-10    pay its share of the principal of and interest on the outstanding
28-11    bonds, notes, or other obligations, and related costs.  The board
28-12    may grant the petition and order the territory described in the
28-13    petition annexed to the authority if:
28-14                (1)  it is feasible, practicable, and to the advantage
28-15    of the authority; and
28-16                (2)  the authority's system and other improvements are
28-17    sufficient or will be sufficient to supply surface water and
28-18    groundwater to the added territory without harming the territory
28-19    already included in the authority.
28-20          (d)  Any territory that a district located within the
28-21    authority annexes becomes territory of the authority, without any
28-22    action required of the authority, on the effective date of the
28-23    annexation.  The authority by rule may require all districts
28-24    located within the authority to send to the authority written
28-25    notice of the effective date of an annexation and requiring the
28-26    districts to send to the authority copies of any necessary
28-27    documents describing the annexed land and describing the district's
 29-1    boundaries as they exist after inclusion of the annexed land.
 29-2          (e)  The annexation to the authority of territory under this
 29-3    section does not affect the validity of the authority's bonds
 29-4    issued before or after the annexation.
 29-5          SECTION 1.07.  DESCRIPTION OF DIRECTOR PRECINCTS. (a)  The
 29-6    authority includes nine single-member director precincts as
 29-7    follows:
 29-8                (1)  Director Precinct No. 1 includes the territory
 29-9    that is contained in the following area:

 59-7          (b)  The territory of any district or municipality within the

59-11    Harris County territory is located.
59-12          (c)  The board may redraw the single-member director
59-13    precincts in a manner that is reasonable and equitable:
59-14                (1)  after any change in the boundaries of the
59-15    authority; or
59-16                (2)  by a resolution redrawing the director precincts
59-17    adopted by a two-thirds majority of the board based on changed
59-18    circumstances.
59-19          SECTION 1.08.  APPLICABILITY OF OTHER LAW. (a)  This Act
59-20    prevails over any inconsistent provision of general law.
59-21          (b)  This Act does not prevail over or preempt a provision of
59-22    Chapter 151, Water Code, or Chapter 36, Water Code, that is being
59-23    implemented by the subsidence district.
59-24          SECTION 1.09.  FINDING OF BENEFIT. All the land, property,
59-25    and persons included within the boundaries of the authority will be
59-26    directly benefited by the works, projects, improvements, and
59-27    services to be provided by the authority under powers conferred by
 60-1    Section 59, Article XVI, Texas Constitution, and this Act.  The
 60-2    authority is created to serve a public use and benefit.  The
 60-3    creation of the authority will serve to promote the health, safety,
 60-4    and general welfare of persons within the authority, and the
 60-5    general public.  Any fees, user fees, rates, charges, or special
 60-6    assessments levied by the authority under this Act are necessary to
 60-7    pay for the costs of accomplishing the purposes of the authority as
 60-8    set forth in Section 59, Article XVI, Texas Constitution, and this
 60-9    Act, including:
60-10                (1)  the reduction of groundwater withdrawals;
60-11                (2)  the facilitation of compliance with subsidence
60-12    district requirements; and
60-13                (3)  the provision of services, facilities, and
60-14    systems.
60-15          SECTION 1.10.  LIBERAL CONSTRUCTION OF THIS ACT. This Act
60-16    shall be liberally construed in conformity with the purposes stated
60-17    in this Act.
60-18                           ARTICLE 2.  DIRECTORS
60-19          SECTION 2.01.  BOARD OF DIRECTORS. (a)  The authority is
60-20    governed by a board of nine directors.
60-21          (b)  The directors serve staggered four-year terms.
60-22          (c)  Each director must qualify to serve as director in the
60-23    manner provided by Section 49.055, Water Code.
60-24          (d)  To be eligible to serve as a director of the authority
60-25    or to be listed on a ballot as a candidate for director of the
60-26    authority representing a director precinct under Section 2.02 of
60-27    this Act, an individual must:
 61-1                (1)  be at least 18 years of age;
 61-2                (2)  be a resident of this state;
 61-3                (3)  own land or be a qualified voter within the
 61-4    director precinct; and
 61-5                (4)  have served as a director of one or more districts
 61-6    for a total of four years or more.
 61-7          (e)  Notwithstanding Subsection (d) of this section, to serve
 61-8    as director of the authority representing, or to be listed on a
 61-9    ballot as a candidate for director of the authority representing, a
61-10    director precinct under Section 2.02 of this Act that includes any
61-11    part of the City of Katy, an individual must:
61-12                (1)  meet the qualifications provided by Subsections
61-13    (d)(1)-(3) of this section; and
61-14                (2)  must have served as:
61-15                      (A)  the mayor or a member of the city council of
61-16    the City of Katy for any period; or
61-17                      (B)  a director of a district for four years or
61-18    more.
61-19          (f)  A director serves until the director's successor has
61-20    qualified.
61-21          (g)  The common law doctrine of incompatibility does not
61-22    disqualify an official or employee of a municipality from serving
61-23    as a director of the authority.  Notwithstanding any other law, a
61-24    director may participate in all votes and decisions pertaining to
61-25    the business of the authority.  A director who is also an officer
61-26    or employee of a public entity may not participate in the
61-27    discussion of or vote on a matter regarding a contract with that
 62-1    public entity.
 62-2          SECTION 2.02.  METHOD OF APPOINTMENT OF DIRECTORS. (a)  The
 62-3    governing bodies of the districts and municipalities located within
 62-4    each director precinct jointly shall appoint one director to
 62-5    represent the precinct by a vote conducted as provided by this
 62-6    section.
 62-7          (b)  If a district or municipality is located within two or
 62-8    more director precincts, the district or municipality is
 62-9    considered, for purposes of this article, to be located only within
62-10    the director precinct in which the greatest amount of territory of
62-11    the district or municipality is located.
62-12          (c)  For the appointment of a director for a director
62-13    precinct, the board shall determine the number of votes each
62-14    district or municipality may cast. The number of votes for a
62-15    governing body of a district or municipality within the precinct is
62-16    equal to the number computed by dividing the total number of units
62-17    of water, as determined by the board, used within the district or
62-18    municipality during the calendar year preceding the year in which
62-19    the selection of the director is done by the total number of units
62-20    of water used by all districts and municipalities in the precinct,
62-21    multiplying that quotient by 100, and rounding that result to the
62-22    nearest tenth.  The board shall provide the presiding officer of
62-23    each governing body of a district or municipality within each
62-24    director precinct written notice of the number of votes computed
62-25    for that governing body to cast.
62-26          (d)  For purposes of Subsection (c), the board shall
62-27    determine the amount of water usage of all districts and
 63-1    municipalities within each director precinct.
 63-2          (e)  The governing body of each district or municipality in
 63-3    the authority by resolution shall nominate one candidate for the
 63-4    position of director for the director precinct in which the
 63-5    district or municipality is located.  Each district or municipality
 63-6    shall submit the name of its candidate to the presiding officer of
 63-7    the authority by February 15 of each even-numbered year. Before
 63-8    March 15 of each even-numbered year, the board shall prepare, for
 63-9    each director precinct, a ballot listing all the candidates for
63-10    that director precinct and shall provide a copy of the ballot to
63-11    the presiding officer of the governing body of each district or
63-12    municipality located within that director precinct.  An individual
63-13    may not be listed as a candidate on the ballot of more than one
63-14    director precinct.  If a candidate is nominated in more than one
63-15    director precinct, the candidate must choose to be on the ballot of
63-16    only one director precinct.
63-17          (f)  The governing body of each district or municipality
63-18    shall determine its vote for director by resolution and submit it
63-19    to the presiding officer of the authority before May 1 of each
63-20    even-numbered year.  In casting its vote for director, the
63-21    governing body of each district or municipality may vote for only
63-22    one candidate on the ballot for the director precinct in which the
63-23    district or municipality is located.  For each director precinct,
63-24    the board shall count the votes, declare elected the candidate who
63-25    received the greatest number of votes from districts or
63-26    municipalities located within that director precinct, and submit
63-27    the results before May 15 of each even-numbered year to the
 64-1    governing body of each district or municipality within the
 64-2    authority.
 64-3          (g)  The board may adopt rules regarding:
 64-4                (1)  the manner and timing of determinations and
 64-5    calculations required by this section;
 64-6                (2)  the reporting of water usage to the authority by
 64-7    districts and municipalities; and
 64-8                (3)  the conduct and process of the appointment of
 64-9    directors.
64-10          SECTION 2.03.  VACANCY IN OFFICE OF DIRECTOR. A vacancy in
64-11    the office of director shall be filled by appointment by the
64-12    governing bodies of the districts and municipalities that are
64-13    located within the director precinct for which the vacancy
64-14    occurred.  The appointment process shall follow the procedures of
64-15    Section 2.02 of this Act.  The board may establish dates different
64-16    than those specified by Sections 2.02(e) and (f) of this Act, but
64-17    the date for the board's submission of the voting results to each
64-18    district and municipality may not be later than the 120th day after
64-19    the date the vacancy occurs.
64-20          SECTION 2.04.  INITIAL DIRECTORS. (a) The initial board
64-21    consists of:

 65-5          (b)  At the first meeting of the initial board, or as soon as
 65-6    practicable after that meeting, the directors shall draw lots to
 65-7    determine their terms so that:
 65-8                (1)  five directors serve until the first appointment
 65-9    of directors under Section 2.02 of this Act; and
65-10                (2)  four directors serve until the second appointment
65-11    of directors under Section 2.02 of this Act.
65-12                   ARTICLE 3.  ADMINISTRATIVE PROVISIONS
65-13          SECTION 3.01.  MEETINGS AND ACTIONS OF BOARD. (a)  The board
65-14    may meet as many times each year as the board considers
65-15    appropriate.
65-16          (b)  Directors of the authority are public officials and are
65-17    entitled to governmental immunity for their actions in their
65-18    capacity as directors and officers of the authority.
65-19          SECTION 3.02.  GENERAL MANAGER. (a)  The board may employ a
65-20    general manager of the authority or contract with a person to
65-21    perform the duties of a general manager.  The board may delegate to
65-22    the general manager full authority to manage and operate the
65-23    affairs of the authority subject only to orders of the board.
65-24          (b)  The board may delegate to the general manager the
65-25    authority to employ all persons necessary for the proper handling
65-26    of the business and operation of the authority and to determine the
65-27    compensation to be paid to all employees, other than the general
 66-1    manager.
 66-2                       ARTICLE 4.  POWERS AND DUTIES
 66-3          SECTION 4.01.  GENERAL POWERS AND DUTIES. (a)  The authority
 66-4    has all of the rights, powers, privileges, authority, functions,
 66-5    and duties necessary and convenient to accomplish the purposes of
 66-6    this Act, including those provided by Chapter 49, Water Code.
 66-7          (b)  The authority may:
 66-8                (1)  provide for the conservation, preservation,
 66-9    protection, recharge, and prevention of waste of groundwater, and
66-10    for the reduction of groundwater withdrawals as necessary to
66-11    develop, implement, or enforce a groundwater reduction plan, in a
66-12    manner consistent with the purposes of Section 59, Article XVI,
66-13    Texas Constitution, and facilitate compliance with subsidence
66-14    district rules, orders, regulations, or requirements;
66-15                (2)  acquire or develop surface water and groundwater
66-16    supplies from sources inside or outside the boundaries of the
66-17    authority and may conserve, store, transport, treat, purify,
66-18    distribute, sell, and deliver water to or among persons,
66-19    corporations, municipalities, municipal corporations, political
66-20    subdivisions of the state, and others, inside and outside the
66-21    boundaries of the authority, and allocate water among persons
66-22    participating in the authority's groundwater reduction plan whether
66-23    they are located inside or outside the authority's boundaries;
66-24                (3)  enter into contracts with persons inside or
66-25    outside the authority on terms and conditions the board considers
66-26    desirable, fair, and advantageous for the performance of its
66-27    rights, powers, and authority under this Act;
 67-1                (4)  coordinate water services provided inside,
 67-2    outside, or into the authority; and
 67-3                (5)  administer and enforce the provisions of this Act.
 67-4          (c)  The authority's rights, powers, privileges, authority,
 67-5    functions, and duties are subject to the continuing right of
 67-6    supervision of the state, to be exercised by and through the
 67-7    commission.
 67-8          (d)  Sections 49.451-49.455, Water Code, do not apply to the
 67-9    authority.
67-10          SECTION 4.02.  AUTHORITY RULES.  The authority may adopt and
67-11    enforce rules reasonably required to implement this Act, including
67-12    rules governing procedures before the board and rules regarding
67-13    implementation, enforcement, and any other matters related to the
67-14    authority's water supply or groundwater reduction plan.
67-15          SECTION 4.03.  FEES, USER FEES, RATES, AND CHARGES. (a)  The
67-16    authority may establish fees, user fees, rates, and charges and
67-17    classifications of fee and ratepayers, as necessary to enable the
67-18    authority to fulfill the authority's purposes and regulatory
67-19    functions provided by this Act.  The authority may impose fees,
67-20    user fees, rates, and charges on any person within the authority,
67-21    including a local government.
67-22          (b)  The authority may charge the owner of a well located
67-23    within the authority's boundaries a fee or user fee according to
67-24    the amount of water pumped from the well.
67-25          (c)  The board shall make reasonable efforts to send
67-26    districts and municipalities within the authority written notice of
67-27    the date, time, and location of the meeting at which the board
 68-1    intends to adopt a proposed charge under Subsection (b), and the
 68-2    amount of the proposed charge.
 68-3          (d)  The board shall exempt from the charge under Subsection
 68-4    (b) classes of wells that are not subject to any groundwater
 68-5    reduction requirement imposed by the subsidence district.  If any
 68-6    of those classes of wells become subject to a groundwater reduction
 68-7    requirement imposed by the subsidence district, the authority may
 68-8    impose the charge under Subsection (b) on those classes.  The board
 68-9    by rule may exempt any other classes of wells from the charge under
68-10    Subsection (b).  The board may not apply the charge under
68-11    Subsection (b) to a well:
68-12                (1)  with a casing diameter of less than five inches
68-13    that solely serves a single-family dwelling; or
68-14                (2)  regulated under Chapter 27, Water Code.
68-15          (e)  The authority may establish fees, user fees, rates, and
68-16    charges that are sufficient to:
68-17                (1)  achieve water conservation;
68-18                (2)  prevent waste of water;
68-19                (3)  serve as a disincentive to pumping groundwater;
68-20                (4)  develop, implement, or enforce a groundwater
68-21    reduction plan;
68-22                (5)  accomplish the purposes of this Act, including
68-23    making available alternative water supplies;
68-24                (6)  enable the authority to meet operation and
68-25    maintenance expenses;
68-26                (7)  pay the principal of and interest on notes, bonds,
68-27    and other obligations issued in connection with the exercise of the
 69-1    authority's general powers and duties; and
 69-2                (8)  satisfy all rate covenants relating to the
 69-3    issuance of notes, bonds, and other obligations.
 69-4          (f)  The authority may charge rates established by the
 69-5    authority for water purchased from the authority.
 69-6          SECTION 4.04.  PURCHASE OF WATER FROM ANOTHER ENTITY. If the
 69-7    authority purchases water from another entity for resale to local
 69-8    governments, the authority shall use its best efforts in
 69-9    negotiating with the entity to determine the amount of capital
69-10    costs included in any rates or charges paid by the authority.  The
69-11    authority shall determine the amount of expected capital costs of
69-12    its own system.  The authority shall provide each district or
69-13    municipality within its boundaries information regarding the share
69-14    of the capital costs to be paid by the district or municipality, as
69-15    determined by the authority, and shall provide each district or
69-16    municipality the opportunity to fund its share of the capital costs
69-17    with proceeds from the sale of bonds or fees and charges collected
69-18    by the districts or municipalities.  A district or municipality may
69-19    use any lawful source of revenue, including bond funds, to make
69-20    payment for any sums due to the authority.
69-21          SECTION 4.05.  ASSESSMENTS. (a)  The board may undertake
69-22    improvement projects and services that confer a special benefit on
69-23    all or a definable part of the authority.  The board may impose
69-24    special assessments on property in that area, including property of
69-25    a local government, based on the benefit conferred by the
69-26    improvement project or services, to pay all or part of the cost of
69-27    the project and services.  The board may provide improvements and
 70-1    services to an area outside the boundaries of the authority if the
 70-2    board determines that there is a benefit to the authority.  The
 70-3    authority may finance with special assessments any improvement
 70-4    project or service authorized by this Act or any other applicable
 70-5    law.
 70-6          (b)  Services or improvement projects may be financed with
 70-7    special assessments under this Act only after the board holds a
 70-8    public hearing on the advisability of the improvements and services
 70-9    and the proposed assessments.
70-10          (c)  The board shall publish notice of the hearing in a
70-11    newspaper or newspapers with general circulation in Harris and Fort
70-12    Bend counties. The final publication must be made not later than
70-13    the 30th day before the date of the hearing.
70-14          (d)  Notice provided under this section must include:
70-15                (1)  the time and place of the hearing;
70-16                (2)  the general nature of the proposed improvement
70-17    project or services;
70-18                (3)  the estimated cost of the improvement, including
70-19    interest during construction and associated financing costs; and
70-20                (4)  the proposed method of assessment.
70-21          (e)  Written notice containing the information required by
70-22    Subsection (d) of this section shall be mailed by certified mail,
70-23    return receipt requested, not later than the 30th day before the
70-24    date of the hearing.  The notice shall be mailed to each person
70-25    within the authority who holds a permit for a well issued by the
70-26    subsidence district under Chapter 151, Water Code, and whose well
70-27    is subject to a groundwater reduction requirement imposed by the
 71-1    subsidence district.  The subsidence district shall provide to the
 71-2    authority a list of persons who hold a permit for a well issued by
 71-3    the subsidence district.
 71-4          (f)  The board may establish rules regarding procedures for a
 71-5    hearing.  A hearing on the services or improvement project, whether
 71-6    conducted by the board or a hearings examiner, may be adjourned
 71-7    from time to time.  At the conclusion of a hearing conducted by the
 71-8    board, the board shall make written findings and conclusions
 71-9    relating to the advisability of the improvement project or
71-10    services, the nature of the improvement project or services, the
71-11    estimated cost, and the area benefited.  If the board appoints a
71-12    hearings examiner to conduct the hearing, after conclusion of the
71-13    hearing, the hearings examiner shall file with the board a written
71-14    report of the examiner's findings and conclusions.
71-15          (g)  At a hearing on proposed assessments, on adjournment of
71-16    the hearing, or after consideration of the hearings examiner's
71-17    report, the board shall hear and rule on all objections to each
71-18    proposed assessment.  The board may amend proposed assessments for
71-19    any property.  After the board hears and takes action on those
71-20    objections, the board, by order:
71-21                (1)  shall impose the assessments as special
71-22    assessments on the property;
71-23                (2)  shall specify the method of payment of the
71-24    assessments; and
71-25                (3)  may provide that those assessments, including
71-26    interest, be paid in periodic installments.
71-27          (h)  Periodic installments must be in amounts sufficient to
 72-1    meet annual costs for services and improvements as provided by
 72-2    Subsection (j) of this section and continue for the number of years
 72-3    required to retire the indebtedness or pay for the services to be
 72-4    rendered.  The board may provide interest charges or penalties for
 72-5    failure to make timely payment and may impose an amount to cover
 72-6    delinquencies and expenses of collection.
 72-7          (i)  If assessments are imposed for more than one service or
 72-8    improvement project, the board may provide that assessments
 72-9    collected for one service or improvement project may be borrowed to
72-10    be used for another service or improvement project.  The board
72-11    shall establish a procedure for the distribution or use of any
72-12    assessments in excess of those necessary to finance the services or
72-13    improvement project for which those assessments were collected.
72-14          (j)  The board shall apportion the cost of an improvement
72-15    project or services to be assessed against the property in the
72-16    authority according to the special benefits that accrue to the
72-17    property because of the improvement project or services.  The board
72-18    may assess the cost only according to the number of gallons of
72-19    groundwater pumped from wells within the authority that are subject
72-20    to a groundwater reduction requirement imposed by the subsidence
72-21    district.  The board may not assess the cost according to
72-22    groundwater pumped from:
72-23                (1)  a well with a casing diameter of less than five
72-24    inches that solely serves a single-family dwelling; or
72-25                (2)  a well that is regulated by Chapter 27, Water
72-26    Code.
72-27          (k)  The area of the authority to be assessed according to
 73-1    the findings of the board may be the entire authority or any part
 73-2    of the authority and may be less than the area proposed in the
 73-3    notice of the hearing.
 73-4          (l)  The area to be assessed may not include property that is
 73-5    not within the authority boundaries at the time of the hearing
 73-6    unless there is an additional hearing, following the required
 73-7    notice.
 73-8          (m)  Notwithstanding Subsection (l), the owner of land
 73-9    annexed to the authority after the authority has imposed
73-10    assessments may waive the right to notice and an assessment hearing
73-11    and may agree to the imposition and payment of assessments at an
73-12    agreed rate for land annexed to the authority.  A district or
73-13    municipality may waive the right to notice and an assessment
73-14    hearing for land within its boundaries annexed to the authority and
73-15    may agree to the imposition and payment of assessments at an agreed
73-16    rate for the annexed land.
73-17          (n)  The board shall have prepared an assessment roll showing
73-18    the assessments against each property and the board's basis for the
73-19    assessment.  The assessment roll shall be:
73-20                (1)  filed with the secretary of the board or other
73-21    officer who performs the function of secretary; and
73-22                (2)  open for public inspection.
73-23          (o)  After notice and hearing in the manner required for an
73-24    original assessment, the board may make supplemental assessments to
73-25    correct omissions or mistakes in the assessment:
73-26                (1)  relating to the total cost of the improvement
73-27    project or services; or
 74-1                (2)  covering delinquencies or costs of collection.
 74-2          SECTION 4.06.  INTEREST AND PENALTIES. The board may require
 74-3    the payment of interest on any late or unpaid fees, user fees,
 74-4    rates, charges, and special assessments due the authority, but the
 74-5    interest rate may not exceed the interest rate permitted by Section
 74-6    2251.025, Government Code. The board may also impose penalties for
 74-7    the failure to completely or timely make payments to the authority.
 74-8          SECTION 4.07.  CIVIL PENALTY; INJUNCTION. (a)  A person who
 74-9    violates a rule or order of the authority is subject to a civil
74-10    penalty of not more than $5,000, as determined by the board, for
74-11    each violation or each day of a continuing violation.  The person
74-12    shall pay the penalty to the authority.
74-13          (b)  The authority may bring an action to recover the penalty
74-14    in a district court in the county where the violation occurred.
74-15          (c)  The authority may bring an action for injunctive relief
74-16    in a district court in the county where a violation of an authority
74-17    rule or order occurs or is threatened to occur.  The court may
74-18    grant to the authority, without bond or other undertaking, a
74-19    prohibitory or mandatory injunction that the facts warrant,
74-20    including a temporary restraining order, temporary injunction, or
74-21    permanent injunction.
74-22          (d)  The authority may bring an action for a civil penalty
74-23    and injunctive relief in the same proceeding.
74-24          SECTION 4.08.  WATER SUPPLY OR DROUGHT CONTINGENCY PLANS. The
74-25    authority by rule may develop, prepare, revise, adopt, implement,
74-26    enforce, and manage comprehensive water supply or drought
74-27    contingency plans for the authority, or any portion of the
 75-1    authority.
 75-2          SECTION 4.09.  GROUNDWATER REDUCTION PLAN. (a)
 75-3    Notwithstanding any other law, irrespective of whether the
 75-4    authority enters into contracts with local governments located
 75-5    within its boundaries, and irrespective of whether the authority
 75-6    holds any well permit issued by the subsidence district under
 75-7    Chapter 151, Water Code, the authority by rule may, in whole or in
 75-8    part, develop, prepare, revise, adopt, implement, enforce, manage,
 75-9    or participate in a groundwater reduction plan that is applicable
75-10    only to the authority or a groundwater reduction plan that is
75-11    applicable to the authority and one or more persons outside the
75-12    authority.  The authority may require that any groundwater
75-13    reduction plan that the authority, in whole or in part, develops,
75-14    prepares, revises, adopts, implements, enforces, or manages or in
75-15    which the authority participates be the exclusive groundwater
75-16    reduction plan that is binding and mandatory on some or all of the
75-17    territory, persons, or wells located within the authority.  A
75-18    groundwater reduction plan may:
75-19                (1)  specify the measures to be taken to reduce
75-20    groundwater withdrawals;
75-21                (2)  identify alternative sources of water to be
75-22    provided to those affected;
75-23                (3)  identify the rates, terms, and conditions under
75-24    which alternative sources of water will be provided, which may be
75-25    changed from time to time as considered necessary by the authority;
75-26                (4)  specify the dates and extent to which persons or
75-27    districts within the authority's boundaries shall reduce or cease
 76-1    reliance on groundwater and accept water from alternative sources;
 76-2                (5)  include other terms and measures that are
 76-3    consistent with the powers and duties of the authority;
 76-4                (6)  exceed the minimum requirements imposed by the
 76-5    subsidence district, including any applicable groundwater reduction
 76-6    requirements; and
 76-7                (7)  be amended from time to time at the discretion of
 76-8    the authority.
 76-9          (b)  Fees, user fees, rates, charges, and special assessments
76-10    of the authority may be imposed under this Act for a person's
76-11    participation in and benefit derived from the authority's
76-12    groundwater reduction plan or a groundwater reduction plan in which
76-13    the authority participates.
76-14          SECTION 4.10.  ACQUISITION, CONSTRUCTION, AND OPERATION OF
76-15    SYSTEMS. (a)  The authority may:
76-16                (1)  acquire by purchase, gift, lease, contract, or any
76-17    other legal means a water treatment or supply system, or any other
76-18    works, plants, improvements, or facilities necessary or convenient
76-19    to accomplish the purposes of the authority, or any interest of the
76-20    authority, inside or outside the authority's boundaries;
76-21                (2)  design, finance, operate, maintain, or construct a
76-22    water treatment or supply system, or any other works, plants,
76-23    improvements, or facilities necessary or convenient to accomplish
76-24    the purposes of the authority, and provide water services inside or
76-25    outside the authority's boundaries;
76-26                (3)  lease or sell a water treatment or supply system,
76-27    or any other works, plants, improvements, or facilities necessary
 77-1    or convenient to accomplish the purposes of the authority, that the
 77-2    authority constructs or acquires inside or outside the authority's
 77-3    boundaries;
 77-4                (4)  contract with any person to operate or maintain a
 77-5    water treatment or supply system the person owns; or
 77-6                (5)  acquire water rights under any law or permit.
 77-7          (b)  The competitive bidding laws provided by Chapter 49,
 77-8    Water Code, apply to the authority.
 77-9          (c)  The authority may, according to terms and conditions the
77-10    board considers desirable, fair, and advantageous, contract with a
77-11    person outside the authority's boundaries:
77-12                (1)  to allow the person to be included in a
77-13    groundwater reduction plan adopted or implemented, in whole or in
77-14    part, by the authority or in a groundwater reduction plan in which
77-15    the authority participates;
77-16                (2)  to sell water to the person; or
77-17                (3)  to sell the person available excess capacity or
77-18    additional capacity of the authority's water treatment or supply
77-19    system.
77-20          (d)  The authority by rule may require that the plans and
77-21    specifications of water lines to be constructed within the
77-22    authority that are designed or intended to serve more than one
77-23    district or more than one person owning or holding a well permit
77-24    issued by the subsidence district under Chapter 151, Water Code, be
77-25    approved by the authority before the commencement of construction
77-26    of the water lines.
77-27          SECTION 4.11.  SALE OR REUSE OF WATER OR BY-PRODUCT. The
 78-1    authority may store, sell, or reuse:
 78-2                (1)  water; or
 78-3                (2)  any by-product from the authority's operations.
 78-4          SECTION 4.12.  CONTRACTS. (a)  The authority may enter into a
 78-5    contract with a person for the performance of a purpose or function
 78-6    of the authority, including a contract to design, construct,
 78-7    finance, lease, own, manage, operate, or maintain works,
 78-8    improvements, facilities, plants, equipment, or appliances
 78-9    necessary to accomplish a purpose or function of the authority.  A
78-10    contract may be of unlimited duration.
78-11          (b)  The authority may purchase, acquire, finance, or lease
78-12    an interest in a project used for a purpose or function of the
78-13    authority.
78-14          (c)  The authority may contract for:
78-15                (1)  the purchase, sale, or lease of water or water
78-16    rights;
78-17                (2)  the performance of activities within the powers of
78-18    the authority through the purchase, construction, or installation
78-19    of works, improvements, facilities, plants, equipment, or
78-20    appliances; or
78-21                (3)  the design, construction, ownership, management,
78-22    maintenance, or operation of any works, improvements, facilities,
78-23    plants, equipment, or appliances of the authority or another
78-24    person.
78-25          (d)  The authority may purchase surplus property from this
78-26    state, the United States, or another public entity through a
78-27    negotiated contract without bids.
 79-1          SECTION 4.13.  COOPERATION WITH AND ASSISTANCE OF OTHER
 79-2    GOVERNMENTAL ENTITIES. (a)  In implementing this Act, the board may
 79-3    cooperate with and request the assistance of the Texas Water
 79-4    Development Board, the commission, the United States Geological
 79-5    Survey, the subsidence district, other local governments, and other
 79-6    agencies of the United States and this state.
 79-7          (b)  The subsidence district may enter into an interlocal
 79-8    contract with the authority to carry out the authority's purposes
 79-9    and may carry out the governmental functions and services specified
79-10    in the interlocal contract.
79-11          (c)  The board shall endeavor to coordinate with the City of
79-12    Houston to develop a plan for a system to distribute surface water
79-13    in an economical and efficient manner to the authority.
79-14          (d)  In an attempt to minimize costs associated with
79-15    preparing a groundwater reduction plan, the board shall consider
79-16    the usefulness of water supply studies and plans prepared by or on
79-17    behalf of the North Harris County Regional Water Authority, the
79-18    City of Houston, or other governmental entities to the extent such
79-19    studies or plans are available and applicable to the authority.
79-20          SECTION 4.14.  GIFTS AND GRANTS. The authority may accept a
79-21    gift or grant from money collected by the subsidence district under
79-22    Chapter 151, Water Code, to fund the construction, maintenance, or
79-23    operation of a water treatment or supply system.
79-24          SECTION 4.15.  EXPENDITURES. (a)  The authority's money may
79-25    be disbursed only by check, draft, order, federal reserve wire
79-26    system, or other instrument or authorization.
79-27          (b)  Disbursements of the authority must be signed by at
 80-1    least a majority of the directors.  Notwithstanding any other law,
 80-2    the board by resolution may allow the general manager, treasurer,
 80-3    bookkeeper, or other employee of the authority to sign
 80-4    disbursements, except as limited by Subsection (c) of this section.
 80-5          (c)  The board by resolution may allow disbursements to be
 80-6    transferred by federal reserve wire system to accounts in the name
 80-7    of the authority without the necessity of any directors signing the
 80-8    disbursement.  Disbursements of the authority's money by federal
 80-9    reserve wire system to any accounts not in the name of the
80-10    authority must be signed by at least a majority of the directors.
80-11          SECTION 4.16.  AD VALOREM TAXATION. The authority may not
80-12    impose an ad valorem tax.
80-13          SECTION 4.17.  EMINENT DOMAIN. (a)  The authority may acquire
80-14    by condemnation any land, easements, or other property inside the
80-15    authority's boundaries to further authorized purposes, powers, or
80-16    duties of the authority.  The authority may acquire by condemnation
80-17    any land, easements, or other property outside the authority's
80-18    boundaries for the purposes of pumping, storing, treating, or
80-19    transporting water.  When exercising the power of eminent domain
80-20    granted by this section, the authority may elect to condemn either
80-21    the fee simple title or a lesser property interest.
80-22          (b)  The authority shall exercise the right of eminent domain
80-23    in the manner provided by Chapter 21, Property Code.  The authority
80-24    is not required to give bond for appeal or bond for costs in a
80-25    condemnation suit or other suit to which it is a party.  The
80-26    authority is not required to deposit more than the amount of an
80-27    award in a suit.
 81-1          (c)  The authority may not use the power of eminent domain
 81-2    for the condemnation of land for the purpose of acquiring rights to
 81-3    underground water or for the purpose of acquiring water or water
 81-4    rights.
 81-5          (d)  The authority may not use the power of eminent domain
 81-6    for the condemnation of property that is:
 81-7                (1)  owned by a municipality with a population of 1.6
 81-8    million or more or any instrumentality of a municipality with a
 81-9    population of 1.6 million or more, including any local government
81-10    corporation created under Chapter 431, Transportation Code, to aid
81-11    or act on behalf of such a municipality; or
81-12                (2)  located within the municipal limits of a
81-13    municipality with a population of 1.6 million or more.
81-14          (e)  Notwithstanding Subsection (d)(2) of this section, the
81-15    authority may use the power of eminent domain to acquire property
81-16    that is not owned by a municipality of 1.6 million or more that is
81-17    within the municipal limits of a municipality with a population of
81-18    1.6 million or more if:
81-19                (1)  the property is located in an area of the
81-20    municipality that is less than 1,000 feet wide at its narrowest
81-21    point; or
81-22                (2)  the municipality grants permission for the
81-23    condemnation.
81-24          (f)  The authority may not exercise the power of eminent
81-25    domain under this section to acquire property of any kind in a
81-26    county that:
81-27                (1)  has a population of more than 245,000;
 82-1                (2)  borders on the Gulf of Mexico; and
 82-2                (3)  is adjacent to a county with a population of more
 82-3    than 1.6 million.
 82-4                        ARTICLE 5.  BONDS AND NOTES
 82-5          SECTION 5.01.  REVENUE BONDS AND NOTES. (a)  The authority
 82-6    may issue bonds or notes payable solely from revenue from any
 82-7    source, including:
 82-8                (1)  tolls, charges, rates, fees, user fees, and
 82-9    special assessments the authority imposes or collects;
82-10                (2)  the sale of water, water services, water rights or
82-11    capacity, water transmission rights or services, water pumping, or
82-12    any other service or product of the authority provided inside or
82-13    outside the boundaries of the authority;
82-14                (3)  grants or gifts;
82-15                (4)  the ownership or operation of all or a designated
82-16    part of the authority's works, improvements, facilities, plants, or
82-17    equipment; and
82-18                (5)  contracts between the authority and any person.
82-19          (b)  Notes issued by the authority may be first or
82-20    subordinate lien notes at the board's discretion.
82-21          (c)  In connection with any bonds or notes of the authority,
82-22    the authority may exercise any power of an issuer under Chapter
82-23    1371, Government Code.
82-24          (d)  The authority may conduct a public, private, or
82-25    negotiated sale of the bonds or notes.
82-26          (e)  The authority may enter into one or more indentures of
82-27    trust to further secure its bonds or notes.
 83-1          (f)  The authority may issue bonds or notes in more than one
 83-2    series as necessary to carry out the purposes of this Act.  In
 83-3    issuing bonds or notes secured by revenue of the authority, the
 83-4    authority may reserve the right to issue additional bonds or notes
 83-5    secured by the authority's revenue that are on a parity with or are
 83-6    senior or subordinate to the bonds or notes issued earlier.
 83-7          (g)  A resolution of the board authorizing the bonds or notes
 83-8    or a trust indenture securing the bonds or notes may specify
 83-9    additional provisions that constitute a contract between the
83-10    authority and its bondholders or noteholders.
83-11          (h)  Bonds and notes may be additionally secured by deed of
83-12    trust or mortgage on any or all of the authority's facilities.
83-13          (i)  Section 49.181, Water Code, does not apply to bonds or
83-14    notes issued by the authority.
83-15          SECTION 5.02.  REFUNDING BONDS. The authority may issue
83-16    refunding bonds and notes to refund any of its bonds or notes in
83-17    any manner provided by law.
83-18                   ARTICLE 6.  MISCELLANEOUS PROVISIONS
83-19          SECTION 6.01.  FINDINGS RELATED TO PROCEDURAL REQUIREMENTS.
83-20    (a)  The proper and legal notice of the intention to introduce this
83-21    Act, setting out the general substance of this Act, has been
83-22    published as provided by law, and the notice and a copy of this Act
83-23    have been furnished to all persons, agencies, officials, or
83-24    entities to which they are required to be furnished by the
83-25    constitution and other laws of this state, including the governor,
83-26    who has submitted the notice and this Act to the commission.
83-27          (b)  The commission has filed its recommendations relating to
 84-1    this Act with the governor, lieutenant governor, and speaker of the
 84-2    house of representatives within the required time.
 84-3          (c)  All requirements of the constitution and laws of this
 84-4    state and the rules and procedures of the legislature with respect
 84-5    to notice, introduction, and passage of this Act are fulfilled and
 84-6    accomplished.
 84-7          SECTION 6.02.  EFFECTIVE DATE. This Act takes effect
 84-8    immediately if it receives a vote of two-thirds of all the members
 84-9    elected to each house, as provided by Section 39, Article III,
84-10    Texas Constitution.  If this Act does not receive the vote
84-11    necessary for immediate effect, this Act takes effect September 1,
84-12    2001.
