 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the creation, administration, powers, duties,
 1-9     operation, and financing of the West Harris County Regional Water
1-10     Authority; granting the power of eminent domain; granting the
1-11     authority to issue bonds or notes; providing a civil penalty.
1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13                       ARTICLE 1.  GENERAL PROVISIONS
1-14           SECTION 1.01.  CREATION. (a)  A regional water authority, to
1-15     be known as the West Harris County Regional Water Authority, is
1-16     created in Harris County.  The authority is a political subdivision
1-17     of this state, a governmental agency, and a body politic and
1-18     corporate.
1-19           (b)  The authority is created under and is essential to
1-20     accomplish the purposes of Section 59, Article XVI, Texas
1-21     Constitution, including the acquisition and provision of surface
1-22     water and groundwater for residential, commercial, industrial,
1-23     agricultural, and other uses, the reduction of groundwater
1-24     withdrawals, the conservation, preservation, protection, recharge,
1-25     and prevention of waste of groundwater, and of groundwater
1-26     reservoirs or their subdivisions, the control of subsidence caused
1-27     by withdrawal of water from those groundwater reservoirs or their
1-28     subdivisions, and other public purposes stated in this Act.
1-29           SECTION 1.02.  DEFINITIONS. In this Act:
1-30                 (1)  "Authority" means the West Harris County Regional
1-31     Water Authority.
1-32                 (2)  "Board" means the board of directors of the
1-33     authority.
1-34                 (3)  "Commission" means the Texas Natural Resource
1-35     Conservation Commission, or its successor.
1-36                 (4)  "Director" means a member of the board.
1-37                 (5)  "District" means any district created under
1-38     Sections 52(b)(1) and (2), Article III, or Section 59, Article XVI,
1-39     Texas Constitution, regardless of the manner of creation, other
1-40     than:
1-41                       (A)  a navigation district or port authority; or
1-42                       (B)  a district governed by Chapter 36, Water
1-43     Code.
1-44                 (6)  "Groundwater reduction plan" means a plan adopted
1-45     or implemented to supply water, reduce reliance on groundwater,
1-46     regulate groundwater pumping and usage, or require and allocate
1-47     water usage among persons in order to comply with or exceed
1-48     requirements imposed by the subsidence district, including any
1-49     applicable groundwater reduction requirements.
1-50                 (7)  "Local government" means a municipality, county,
1-51     district, or other political subdivision of this state or a
1-52     combination of two or more of those entities.
1-53                 (8)  "Person" includes an individual, corporation,
1-54     organization, government or governmental subdivision or agency,
1-55     district, local government, business trust, estate, trust,
1-56     partnership, association, or any other legal entity.
1-57                 (9)  "Subsidence" has the meaning assigned by Section
1-58     151.002, Water Code.
1-59                 (10)  "Subsidence district" means the Harris-Galveston
1-60     Coastal Subsidence District.
1-61                 (11)  "System" means a network of pipelines, conduits,
1-62     valves, canals, pumping stations, force mains, treatment plants,
1-63     and any other construction, device, or related appurtenance used to
1-64     treat or transport water.
 2-1                 (12)  "Water" includes:
 2-2                       (A)  groundwater, percolating or otherwise;
 2-3                       (B)  any surface water, natural or artificial,
 2-4     navigable or nonnavigable; and
 2-5                       (C)  industrial and municipal wastewater.
 2-6                 (13)  "Well" includes a facility, device, or method
 2-7     used to withdraw groundwater from a groundwater source within the
 2-8     boundaries of the authority.
 2-9           SECTION 1.03.  DESCRIPTION OF BOUNDARIES. (a)  The authority
2-10     includes the territory that is contained in the following area,
2-11     regardless of whether the territory contains noncontiguous parcels
2-12     of land or whether the territory is located within the boundaries
2-13     of any other governmental entity or political subdivision of the
2-14     state:
2-15     TRACT-1
2-16     BEGINNING at the intersection of the easterly right-of-way of
2-17     Kickapoo Road with the northerly line of U. S. Highway 290
2-18     (Hempstead Highway);
2-19     THENCE, southeasterly along the northerly line of U. S. Highway 290
2-20     to its intersection with the easterly right-of-way line of
2-21     Brittmore Road;
2-22     THENCE, generally along the current City of Houston corporate
2-23     limits the following:
2-24           southerly along the easterly right-of-way line of Brittmore
2-25     Road to its intersection with the northerly right-of-way line of
2-26     West Little York Road;
2-27           easterly along the northerly right-of-way line of West Little
2-28     York Road to its intersection with the most easterly westerly
2-29     boundary of the former Northwest Harris County MUD 25 as it existed
2-30     on December 4, 1996;
2-31     southerly along the most easterly westerly boundary of the former
2-32     Northwest Harris County MUD 25 to the most southerly  southerly
2-33     boundary of the former Northwest Harris County MUD 25 as it existed
2-34     on December 4, 1996;
2-35           easterly along the most southerly southerly boundary of the
2-36     former Northwest Harris County MUD 25 as it existed on December 4,
2-37     1996 to the westerly right-of-way line of the West Sam Houston
2-38     Parkway North;
2-39           southerly along the westerly right-of-way line of the West
2-40     Sam Houston Parkway North to the    southerly line of the E.
2-41     Friedenhaus Survey, Abstract 1185;
2-42           westerly along the southerly line of the E. Friedenhaus
2-43     Survey, Abstract 1185 to the southwest corner of said survey, same
2-44     being the northeast corner of the W. C. R. R. Survey, Abstract 917;

10-31    territory described by Subsection (a) of this section, regardless
10-32    of whether the territory contains noncontiguous parcels of land.
10-33          (c)  Notwithstanding Subsections (a) and (b) of this section,
10-34    the authority does not include any area that, on the effective date
10-35    of this Act, is inside:
10-36                (1)  the municipal limits of the City of Houston;
10-37                (2)  the municipal limits or extraterritorial
10-38    jurisdiction, as determined under Subchapter B, Chapter 42, Local
10-39    Government Code, of the City of Jersey Village;
10-40                (3)  the territory of the North Harris County Regional
10-41    Water Authority; or
10-42                (4)  the boundaries of Waller County.
10-43          (d)  All of the territory of a local government created after
10-44    the effective date of this Act that encompasses any territory
10-45    within the boundaries of the authority, immediately on the creation
10-46    and any necessary confirmation election, and without any action
10-47    required of the authority, is subject to all of the rights, powers,
10-48    privileges, and rules of the authority, to the same extent as the
10-49    territory was before the local government was created.
10-50          SECTION 1.04.  FINDINGS RELATIVE TO BOUNDARIES. The
10-51    legislature finds that the boundaries and field notes of the
10-52    authority form a closure.  If a mistake is made in the field notes
10-53    or in copying the field notes in the legislative process, it does
10-54    not affect the authority's:
10-55                (1)  organization, existence, or validity;
10-56                (2)  right to issue any type of bond or note for the
10-57    purposes for which the authority is created or to pay the principal
10-58    of and interest on a bond or note;
10-59                (3)  right to impose or collect a fee, user fee, rate,
10-60    charge, or special assessment; or
10-61                (4)  legality or operation.
10-62          SECTION 1.05.  EXCLUSION OF CERTAIN TERRITORY. (a)  A
10-63    district or municipality that, on the effective date of this Act,
10-64    is located, wholly or partly, within the territory described by
10-65    Section 1.03(a) or (b) of this Act may petition for exclusion of
10-66    all of its territory from the authority's boundaries by a petition
10-67    signed by a majority of the governing body of the district or
10-68    municipality.  The board shall:
10-69                (1)  not later than February 28, 2002, grant the
 11-1    petition and order the territory excluded if the petition:
 11-2                      (A)  includes an accurate legal description of
 11-3    the boundaries of the territory to be excluded; and
 11-4                      (B)  is filed with the authority before December
 11-5    31, 2001; and
 11-6                (2)  if the board grants the petition, file for
 11-7    recording in the office of the county clerk for the applicable
 11-8    county or counties a copy of the order and a description of the
 11-9    authority's boundaries as they exist after the exclusion of the
11-10    territory.
11-11          (b)  If a district or municipality is excluded from the
11-12    authority's boundaries under this section, the authority:
11-13                (1)  is not required to provide water or any other
11-14    service to the district or municipality; and
11-15                (2)  is not required to include the district or
11-16    municipality in any groundwater reduction plan adopted or
11-17    implemented by the authority.
11-18          (c)  If, before December 31, 2001, a district or municipality
11-19    files a petition for exclusion under this section, the authority
11-20    may not impose fees, user fees, rates, charges, or special
11-21    assessments on the district or municipality after the petition is
11-22    filed with and received by the authority unless the district or
11-23    municipality is annexed by the authority under Section 1.06.
11-24          (d)  If a district or municipality excluded from the
11-25    authority's boundaries under this section petitions the authority
11-26    to be annexed under Section 1.06 of this Act, the authority may
11-27    annex the district or municipality.  The authority may, as a
11-28    condition of annexation, require terms and conditions the board
11-29    considers appropriate.  The authority may require the district or
11-30    municipality to pay the authority the fees, user fees, charges, and
11-31    special assessments, with interest, that, as determined by the
11-32    authority, the district or municipality would have been charged by
11-33    the authority if the district or municipality had not been excluded
11-34    from the authority under this section.
11-35          SECTION 1.06.  ANNEXATION. (a)  Except to the extent the
11-36    authority agrees in writing, a municipality's annexation of
11-37    territory within the authority has no effect on:
11-38                (1)  the authority's powers inside or outside the
11-39    annexed territory;
11-40                (2)  the authority's boundaries or contracts; and
11-41                (3)  the authority's ability to assess fees, user fees,
11-42    rates, charges, or special assessments inside or outside the
11-43    territory annexed by the municipality.
11-44          (b)  Territory may be annexed to the authority, regardless of
11-45    whether the territory is contiguous to the authority, as provided
11-46    by Chapter 49, Water Code.
11-47          (c)  In addition to the authority granted by Subsection (b)
11-48    of this section, regardless of whether the territory is contiguous
11-49    to the authority, the authority may annex territory located within
11-50    a district or municipality if the district or municipality files
11-51    with the authority a petition requesting the annexation signed by a
11-52    majority of the governing body of the district or municipality.
11-53    The petition must include an accurate legal description of the
11-54    boundaries of the territory to be included.  If the authority has
11-55    bonds, notes, or other obligations outstanding, the authority shall
11-56    require the petitioning district or municipality to be obligated to
11-57    pay its share of the principal of and interest on the outstanding
11-58    bonds, notes, or other obligations, and related costs.  The board
11-59    may grant the petition and order the territory described in the
11-60    petition annexed to the authority if:
11-61                (1)  it is feasible, practicable, and to the advantage
11-62    of the authority; and
11-63                (2)  the authority's system and other improvements are
11-64    sufficient or will be sufficient to supply surface water and
11-65    groundwater to the added territory without harming the territory
11-66    already included in the authority.
11-67          (d)  Any territory that a district located within the
11-68    authority annexes becomes territory of the authority, without any
11-69    action required of the authority, on the effective date of the
 12-1    annexation.  The authority by rule may require all districts
 12-2    located within the authority to send to the authority written
 12-3    notice of the effective date of an annexation and requiring the
 12-4    districts to send to the authority copies of any necessary
 12-5    documents describing the annexed land and describing the district's
 12-6    boundaries as they exist after inclusion of the annexed land.
 12-7          (e)  The annexation to the authority of territory under this
 12-8    section does not affect the validity of the authority's bonds
 12-9    issued before or after the annexation.
12-10          SECTION 1.07.  DESCRIPTION OF DIRECTOR PRECINCTS. (a)  The
12-11    authority includes nine single-member director precincts as
12-12    follows:

23-63          (b)  The territory of any district or municipality within the
23-64    authority that is located within Fort Bend County is part of the
23-65    director precinct described by Subsection (a) of this section in
23-66    which the greatest amount of the district's or municipality's
23-67    Harris County territory is located.
23-68          (c)  The board may redraw the single-member director
23-69    precincts in a manner that is reasonable and equitable:
 24-1                (1)  after any change in the boundaries of the
 24-2    authority; or
 24-3                (2)  by a resolution redrawing the director precincts
 24-4    adopted by a two-thirds majority of the board based on changed
 24-5    circumstances.
 24-6          SECTION 1.08.  APPLICABILITY OF OTHER LAW. (a)  This Act
 24-7    prevails over any inconsistent provision of general law.
 24-8          (b)  This Act does not prevail over or preempt a provision of
 24-9    Chapter 151, Water Code, or Chapter 36, Water Code, that is being
24-10    implemented by the subsidence district.
24-11          SECTION 1.09.  FINDING OF BENEFIT. All the land, property,
24-12    and persons included within the boundaries of the authority will be
24-13    directly benefited by the works, projects, improvements, and
24-14    services to be provided by the authority under powers conferred by
24-15    Section 59, Article XVI, Texas Constitution, and this Act.  The
24-16    authority is created to serve a public use and benefit.  The
24-17    creation of the authority will serve to promote the health, safety,
24-18    and general welfare of persons within the authority, and the
24-19    general public.  Any fees, user fees, rates, charges, or special
24-20    assessments levied by the authority under this Act are necessary to
24-21    pay for the costs of accomplishing the purposes of the authority as
24-22    set forth in Section 59, Article XVI, Texas Constitution, and this
24-23    Act, including:
24-24                (1)  the reduction of groundwater withdrawals;
24-25                (2)  the facilitation of compliance with subsidence
24-26    district requirements; and
24-27                (3)  the provision of services, facilities, and
24-28    systems.
24-29          SECTION 1.10.  LIBERAL CONSTRUCTION OF THIS ACT. This Act
24-30    shall be liberally construed in conformity with the purposes stated
24-31    in this Act.
24-32                           ARTICLE 2.  DIRECTORS
24-33          SECTION 2.01.  BOARD OF DIRECTORS. (a)  The authority is
24-34    governed by a board of nine directors.
24-35          (b)  The directors serve staggered four-year terms.
24-36          (c)  Each director must qualify to serve as director in the
24-37    manner provided by Section 49.055, Water Code.
24-38          (d)  To be eligible to serve as a director of the authority
24-39    or to be listed on a ballot as a candidate for director of the
24-40    authority representing a director precinct under Section 2.02 of
24-41    this Act, an individual must:
24-42                (1)  be at least 18 years of age;
24-43                (2)  be a resident of this state;
24-44                (3)  own land or be a qualified voter within the
24-45    director precinct; and
24-46                (4)  have served as a director of one or more districts
24-47    for a total of four years or more.
24-48          (e)  Notwithstanding Subsection (d) of this section, to serve
24-49    as director of the authority representing, or to be listed on a
24-50    ballot as a candidate for director of the authority representing, a
24-51    director precinct under Section 2.02 of this Act that includes any
24-52    part of the City of Katy, an individual must:
24-53                (1)  meet the qualifications provided by Subsections
24-54    (d)(1)-(3) of this section; and
24-55                (2)  must have served as:
24-56                      (A)  the mayor or a member of the city council of
24-57    the City of Katy for any period; or
24-58                      (B)  a director of a district for four years or
24-59    more.
24-60          (f)  A director serves until the director's successor has
24-61    qualified.
24-62          (g)  The common law doctrine of incompatibility does not
24-63    disqualify an official or employee of a municipality from serving
24-64    as a director of the authority.  Notwithstanding any other law, a
24-65    director may participate in all votes and decisions pertaining to
24-66    the business of the authority.  A director who is also an officer
24-67    or employee of a public entity may not participate in the
24-68    discussion of or vote on a matter regarding a contract with that
24-69    public entity.
 25-1          SECTION 2.02.  METHOD OF APPOINTMENT OF DIRECTORS. (a)  The
 25-2    governing bodies of the districts and municipalities located within
 25-3    each director precinct jointly shall appoint one director to
 25-4    represent the precinct by a vote conducted as provided by this
 25-5    section.
 25-6          (b)  If a district or municipality is located within two or
 25-7    more director precincts, the district or municipality is
 25-8    considered, for purposes of this article, to be located only within
 25-9    the director precinct in which the greatest amount of territory of
25-10    the district or municipality is located.
25-11          (c)  For the appointment of a director for a director
25-12    precinct, the board shall determine the number of votes each
25-13    district or municipality may cast. The number of votes for a
25-14    governing body of a district or municipality within the precinct is
25-15    equal to the number computed by dividing the total number of units
25-16    of water, as determined by the board, used within the district or
25-17    municipality during the calendar year preceding the year in which
25-18    the selection of the director is done by the total number of units
25-19    of water used by all districts and municipalities in the precinct,
25-20    multiplying that quotient by 100, and rounding that result to the
25-21    nearest tenth.  The board shall provide the presiding officer of
25-22    each governing body of a district or municipality within each
25-23    director precinct written notice of the number of votes computed
25-24    for that governing body to cast.
25-25          (d)  For purposes of Subsection (c), the board shall
25-26    determine the amount of water usage of all districts and
25-27    municipalities within each director precinct.
25-28          (e)  The governing body of each district or municipality in
25-29    the authority by resolution shall nominate one candidate for the
25-30    position of director for the director precinct in which the
25-31    district or municipality is located.  Each district or municipality
25-32    shall submit the name of its candidate to the presiding officer of
25-33    the authority by February 15 of each even-numbered year. Before
25-34    March 15 of each even-numbered year, the board shall prepare, for
25-35    each director precinct, a ballot listing all the candidates for
25-36    that director precinct and shall provide a copy of the ballot to
25-37    the presiding officer of the governing body of each district or
25-38    municipality located within that director precinct.  An individual
25-39    may not be listed as a candidate on the ballot of more than one
25-40    director precinct.  If a candidate is nominated in more than one
25-41    director precinct, the candidate must choose to be on the ballot of
25-42    only one director precinct.
25-43          (f)  The governing body of each district or municipality
25-44    shall determine its vote for director by resolution and submit it
25-45    to the presiding officer of the authority before May 1 of each
25-46    even-numbered year.  In casting its vote for director, the
25-47    governing body of each district or municipality may vote for only
25-48    one candidate on the ballot for the director precinct in which the
25-49    district or municipality is located.  For each director precinct,
25-50    the board shall count the votes, declare elected the candidate who
25-51    received the greatest number of votes from districts or
25-52    municipalities located within that director precinct, and submit
25-53    the results before May 15 of each even-numbered year to the
25-54    governing body of each district or municipality within the
25-55    authority.
25-56          (g)  The board may adopt rules regarding:
25-57                (1)  the manner and timing of determinations and
25-58    calculations required by this section;
25-59                (2)  the reporting of water usage to the authority by
25-60    districts and municipalities; and
25-61                (3)  the conduct and process of the appointment of
25-62    directors.
25-63          SECTION 2.03.  VACANCY IN OFFICE OF DIRECTOR. A vacancy in
25-64    the office of director shall be filled by appointment by the
25-65    governing bodies of the districts and municipalities that are
25-66    located within the director precinct for which the vacancy
25-67    occurred.  The appointment process shall follow the procedures of
25-68    Section 2.02 of this Act.  The board may establish dates different
25-69    than those specified by Sections 2.02(e) and (f) of this Act, but
 26-1    the date for the board's submission of the voting results to each
 26-2    district and municipality may not be later than the 120th day after
 26-3    the date the vacancy occurs.
 26-4          SECTION 2.04.  INITIAL DIRECTORS. (a) The initial board
 26-5    consists of:

26-16          (b)  At the first meeting of the initial board, or as soon as
26-17    practicable after that meeting, the directors shall draw lots to
26-18    determine their terms so that:
26-19                (1)  five directors serve until the first appointment
26-20    of directors under Section 2.02 of this Act; and
26-21                (2)  four directors serve until the second appointment
26-22    of directors under Section 2.02 of this Act.
26-23                   ARTICLE 3.  ADMINISTRATIVE PROVISIONS
26-24          SECTION 3.01.  MEETINGS AND ACTIONS OF BOARD. (a)  The board
26-25    may meet as many times each year as the board considers
26-26    appropriate.
26-27          (b)  Directors of the authority are public officials and are
26-28    entitled to governmental immunity for their actions in their
26-29    capacity as directors and officers of the authority.
26-30          SECTION 3.02.  GENERAL MANAGER. (a)  The board may employ a
26-31    general manager of the authority or contract with a person to
26-32    perform the duties of a general manager.  The board may delegate to
26-33    the general manager full authority to manage and operate the
26-34    affairs of the authority subject only to orders of the board.
26-35          (b)  The board may delegate to the general manager the
26-36    authority to employ all persons necessary for the proper handling
26-37    of the business and operation of the authority and to determine the
26-38    compensation to be paid to all employees, other than the general
26-39    manager.
26-40                       ARTICLE 4.  POWERS AND DUTIES
26-41          SECTION 4.01.  GENERAL POWERS AND DUTIES. (a)  The authority
26-42    has all of the rights, powers, privileges, authority, functions,
26-43    and duties necessary and convenient to accomplish the purposes of
26-44    this Act, including those provided by Chapter 49, Water Code.
26-45          (b)  The authority may:
26-46                (1)  provide for the conservation, preservation,
26-47    protection, recharge, and prevention of waste of groundwater, and
26-48    for the reduction of groundwater withdrawals as necessary to
26-49    develop, implement, or enforce a groundwater reduction plan, in a
26-50    manner consistent with the purposes of Section 59, Article XVI,
26-51    Texas Constitution, and facilitate compliance with subsidence
26-52    district rules, orders, regulations, or requirements;
26-53                (2)  acquire or develop surface water and groundwater
26-54    supplies from sources inside or outside the boundaries of the
26-55    authority and may conserve, store, transport, treat, purify,
26-56    distribute, sell, and deliver water to or among persons,
26-57    corporations, municipalities, municipal corporations, political
26-58    subdivisions of the state, and others, inside and outside the
26-59    boundaries of the authority, and allocate water among persons
26-60    participating in the authority's groundwater reduction plan whether
26-61    they are located inside or outside the authority's boundaries;
26-62                (3)  enter into contracts with persons inside or
26-63    outside the authority on terms and conditions the board considers
26-64    desirable, fair, and advantageous for the performance of its
26-65    rights, powers, and authority under this Act;
26-66                (4)  coordinate water services provided inside,
26-67    outside, or into the authority; and
26-68                (5)  administer and enforce the provisions of this Act.
26-69          (c)  The authority's rights, powers, privileges, authority,
 27-1    functions, and duties are subject to the continuing right of
 27-2    supervision of the state, to be exercised by and through the
 27-3    commission.
 27-4          (d)  Sections 49.451-49.455, Water Code, do not apply to the
 27-5    authority.
 27-6          SECTION 4.02.  AUTHORITY RULES.  The authority may adopt and
 27-7    enforce rules reasonably required to implement this Act, including
 27-8    rules governing procedures before the board and rules regarding
 27-9    implementation, enforcement, and any other matters related to the
27-10    authority's water supply or groundwater reduction plan.
27-11          SECTION 4.03.  FEES, USER FEES, RATES, AND CHARGES. (a)  The
27-12    authority may establish fees, user fees, rates, and charges and
27-13    classifications of fee and ratepayers, as necessary to enable the
27-14    authority to fulfill the authority's purposes and regulatory
27-15    functions provided by this Act.  The authority may impose fees,
27-16    user fees, rates, and charges on any person within the authority,
27-17    including a local government.
27-18          (b)  The authority may charge the owner of a well located
27-19    within the authority's boundaries a fee or user fee according to
27-20    the amount of water pumped from the well.
27-21          (c)  The board shall make reasonable efforts to send
27-22    districts and municipalities within the authority written notice of
27-23    the date, time, and location of the meeting at which the board
27-24    intends to adopt a proposed charge under Subsection (b), and the
27-25    amount of the proposed charge.
27-26          (d)  The board shall exempt from the charge under Subsection
27-27    (b) classes of wells that are not subject to any groundwater
27-28    reduction requirement imposed by the subsidence district.  If any
27-29    of those classes of wells become subject to a groundwater reduction
27-30    requirement imposed by the subsidence district, the authority may
27-31    impose the charge under Subsection (b) on those classes.  The board
27-32    by rule may exempt any other classes of wells from the charge under
27-33    Subsection (b).  The board may not apply the charge under
27-34    Subsection (b) to a well:
27-35                (1)  with a casing diameter of less than five inches
27-36    that solely serves a single-family dwelling; or
27-37                (2)  regulated under Chapter 27, Water Code.
27-38          (e)  The authority may establish fees, user fees, rates, and
27-39    charges that are sufficient to:
27-40                (1)  achieve water conservation;
27-41                (2)  prevent waste of water;
27-42                (3)  serve as a disincentive to pumping groundwater;
27-43                (4)  develop, implement, or enforce a groundwater
27-44    reduction plan;
27-45                (5)  accomplish the purposes of this Act, including
27-46    making available alternative water supplies;
27-47                (6)  enable the authority to meet operation and
27-48    maintenance expenses;
27-49                (7)  pay the principal of and interest on notes, bonds,
27-50    and other obligations issued in connection with the exercise of the
27-51    authority's general powers and duties; and
27-52                (8)  satisfy all rate covenants relating to the
27-53    issuance of notes, bonds, and other obligations.
27-54          (f)  The authority may charge rates established by the
27-55    authority for water purchased from the authority.
27-56          SECTION 4.04.  PURCHASE OF WATER FROM ANOTHER ENTITY. If the
27-57    authority purchases water from another entity for resale to local
27-58    governments, the authority shall use its best efforts in
27-59    negotiating with the entity to determine the amount of capital
27-60    costs included in any rates or charges paid by the authority.  The
27-61    authority shall determine the amount of expected capital costs of
27-62    its own system.  The authority shall provide each district or
27-63    municipality within its boundaries information regarding the share
27-64    of the capital costs to be paid by the district or municipality, as
27-65    determined by the authority, and shall provide each district or
27-66    municipality the opportunity to fund its share of the capital costs
27-67    with proceeds from the sale of bonds or fees and charges collected
27-68    by the districts or municipalities.  A district or municipality may
27-69    use any lawful source of revenue, including bond funds, to make
 28-1    payment for any sums due to the authority.
 28-2          SECTION 4.05.  ASSESSMENTS. (a)  The board may undertake
 28-3    improvement projects and services that confer a special benefit on
 28-4    all or a definable part of the authority.  The board may impose
 28-5    special assessments on property in that area, including property of
 28-6    a local government, based on the benefit conferred by the
 28-7    improvement project or services, to pay all or part of the cost of
 28-8    the project and services.  The board may provide improvements and
 28-9    services to an area outside the boundaries of the authority if the
28-10    board determines that there is a benefit to the authority.  The
28-11    authority may finance with special assessments any improvement
28-12    project or service authorized by this Act or any other applicable
28-13    law.
28-14          (b)  Services or improvement projects may be financed with
28-15    special assessments under this Act only after the board holds a
28-16    public hearing on the advisability of the improvements and services
28-17    and the proposed assessments.
28-18          (c)  The board shall publish notice of the hearing in a
28-19    newspaper or newspapers with general circulation in Harris and Fort
28-20    Bend counties. The final publication must be made not later than
28-21    the 30th day before the date of the hearing.
28-22          (d)  Notice provided under this section must include:
28-23                (1)  the time and place of the hearing;
28-24                (2)  the general nature of the proposed improvement
28-25    project or services;
28-26                (3)  the estimated cost of the improvement, including
28-27    interest during construction and associated financing costs; and
28-28                (4)  the proposed method of assessment.
28-29          (e)  Written notice containing the information required by
28-30    Subsection (d) of this section shall be mailed by certified mail,
28-31    return receipt requested, not later than the 30th day before the
28-32    date of the hearing.  The notice shall be mailed to each person
28-33    within the authority who holds a permit for a well issued by the
28-34    subsidence district under Chapter 151, Water Code, and whose well
28-35    is subject to a groundwater reduction requirement imposed by the
28-36    subsidence district.  The subsidence district shall provide to the
28-37    authority a list of persons who hold a permit for a well issued by
28-38    the subsidence district.
28-39          (f)  The board may establish rules regarding procedures for a
28-40    hearing.  A hearing on the services or improvement project, whether
28-41    conducted by the board or a hearings examiner, may be adjourned
28-42    from time to time.  At the conclusion of a hearing conducted by the
28-43    board, the board shall make written findings and conclusions
28-44    relating to the advisability of the improvement project or
28-45    services, the nature of the improvement project or services, the
28-46    estimated cost, and the area benefited.  If the board appoints a
28-47    hearings examiner to conduct the hearing, after conclusion of the
28-48    hearing, the hearings examiner shall file with the board a written
28-49    report of the examiner's findings and conclusions.
28-50          (g)  At a hearing on proposed assessments, on adjournment of
28-51    the hearing, or after consideration of the hearings examiner's
28-52    report, the board shall hear and rule on all objections to each
28-53    proposed assessment.  The board may amend proposed assessments for
28-54    any property.  After the board hears and takes action on those
28-55    objections, the board, by order:
28-56                (1)  shall impose the assessments as special
28-57    assessments on the property;
28-58                (2)  shall specify the method of payment of the
28-59    assessments; and
28-60                (3)  may provide that those assessments, including
28-61    interest, be paid in periodic installments.
28-62          (h)  Periodic installments must be in amounts sufficient to
28-63    meet annual costs for services and improvements as provided by
28-64    Subsection (j) of this section and continue for the number of years
28-65    required to retire the indebtedness or pay for the services to be
28-66    rendered.  The board may provide interest charges or penalties for
28-67    failure to make timely payment and may impose an amount to cover
28-68    delinquencies and expenses of collection.
28-69          (i)  If assessments are imposed for more than one service or
 29-1    improvement project, the board may provide that assessments
 29-2    collected for one service or improvement project may be borrowed to
 29-3    be used for another service or improvement project.  The board
 29-4    shall establish a procedure for the distribution or use of any
 29-5    assessments in excess of those necessary to finance the services or
 29-6    improvement project for which those assessments were collected.
 29-7          (j)  The board shall apportion the cost of an improvement
 29-8    project or services to be assessed against the property in the
 29-9    authority according to the special benefits that accrue to the
29-10    property because of the improvement project or services.  The board
29-11    may assess the cost only according to the number of gallons of
29-12    groundwater pumped from wells within the authority that are subject
29-13    to a groundwater reduction requirement imposed by the subsidence
29-14    district.  The board may not assess the cost according to
29-15    groundwater pumped from:
29-16                (1)  a well with a casing diameter of less than five
29-17    inches that solely serves a single-family dwelling; or
29-18                (2)  a well that is regulated by Chapter 27, Water
29-19    Code.
29-20          (k)  The area of the authority to be assessed according to
29-21    the findings of the board may be the entire authority or any part
29-22    of the authority and may be less than the area proposed in the
29-23    notice of the hearing.
29-24          (l)  The area to be assessed may not include property that is
29-25    not within the authority boundaries at the time of the hearing
29-26    unless there is an additional hearing, following the required
29-27    notice.
29-28          (m)  Notwithstanding Subsection (l), the owner of land
29-29    annexed to the authority after the authority has imposed
29-30    assessments may waive the right to notice and an assessment hearing
29-31    and may agree to the imposition and payment of assessments at an
29-32    agreed rate for land annexed to the authority.  A district or
29-33    municipality may waive the right to notice and an assessment
29-34    hearing for land within its boundaries annexed to the authority and
29-35    may agree to the imposition and payment of assessments at an agreed
29-36    rate for the annexed land.
29-37          (n)  The board shall have prepared an assessment roll showing
29-38    the assessments against each property and the board's basis for the
29-39    assessment.  The assessment roll shall be:
29-40                (1)  filed with the secretary of the board or other
29-41    officer who performs the function of secretary; and
29-42                (2)  open for public inspection.
29-43          (o)  After notice and hearing in the manner required for an
29-44    original assessment, the board may make supplemental assessments to
29-45    correct omissions or mistakes in the assessment:
29-46                (1)  relating to the total cost of the improvement
29-47    project or services; or
29-48                (2)  covering delinquencies or costs of collection.
29-49          SECTION 4.06.  INTEREST AND PENALTIES. The board may require
29-50    the payment of interest on any late or unpaid fees, user fees,
29-51    rates, charges, and special assessments due the authority, but the
29-52    interest rate may not exceed the interest rate permitted by Section
29-53    2251.025, Government Code. The board may also impose penalties for
29-54    the failure to completely or timely make payments to the authority.
29-55          SECTION 4.07.  CIVIL PENALTY; INJUNCTION. (a)  A person who
29-56    violates a rule or order of the authority is subject to a civil
29-57    penalty of not more than $5,000, as determined by the board, for
29-58    each violation or each day of a continuing violation.  The person
29-59    shall pay the penalty to the authority.
29-60          (b)  The authority may bring an action to recover the penalty
29-61    in a district court in the county where the violation occurred.
29-62          (c)  The authority may bring an action for injunctive relief
29-63    in a district court in the county where a violation of an authority
29-64    rule or order occurs or is threatened to occur.  The court may
29-65    grant to the authority, without bond or other undertaking, a
29-66    prohibitory or mandatory injunction that the facts warrant,
29-67    including a temporary restraining order, temporary injunction, or
29-68    permanent injunction.
29-69          (d)  The authority may bring an action for a civil penalty
 30-1    and injunctive relief in the same proceeding.
 30-2          SECTION 4.08.  WATER SUPPLY OR DROUGHT CONTINGENCY PLANS. The
 30-3    authority by rule may develop, prepare, revise, adopt, implement,
 30-4    enforce, and manage comprehensive water supply or drought
 30-5    contingency plans for the authority, or any portion of the
 30-6    authority.
 30-7          SECTION 4.09.  GROUNDWATER REDUCTION PLAN. (a)
 30-8    Notwithstanding any other law, irrespective of whether the
 30-9    authority enters into contracts with local governments located
30-10    within its boundaries, and irrespective of whether the authority
30-11    holds any well permit issued by the subsidence district under
30-12    Chapter 151, Water Code, the authority by rule may, in whole or in
30-13    part, develop, prepare, revise, adopt, implement, enforce, manage,
30-14    or participate in a groundwater reduction plan that is applicable
30-15    only to the authority or a groundwater reduction plan that is
30-16    applicable to the authority and one or more persons outside the
30-17    authority.  The authority may require that any groundwater
30-18    reduction plan that the authority, in whole or in part, develops,
30-19    prepares, revises, adopts, implements, enforces, or manages or in
30-20    which the authority participates be the exclusive groundwater
30-21    reduction plan that is binding and mandatory on some or all of the
30-22    territory, persons, or wells located within the authority.  A
30-23    groundwater reduction plan may:
30-24                (1)  specify the measures to be taken to reduce
30-25    groundwater withdrawals;
30-26                (2)  identify alternative sources of water to be
30-27    provided to those affected;
30-28                (3)  identify the rates, terms, and conditions under
30-29    which alternative sources of water will be provided, which may be
30-30    changed from time to time as considered necessary by the authority;
30-31                (4)  specify the dates and extent to which persons or
30-32    districts within the authority's boundaries shall reduce or cease
30-33    reliance on groundwater and accept water from alternative sources;
30-34                (5)  include other terms and measures that are
30-35    consistent with the powers and duties of the authority;
30-36                (6)  exceed the minimum requirements imposed by the
30-37    subsidence district, including any applicable groundwater reduction
30-38    requirements; and
30-39                (7)  be amended from time to time at the discretion of
30-40    the authority.
30-41          (b)  Fees, user fees, rates, charges, and special assessments
30-42    of the authority may be imposed under this Act for a person's
30-43    participation in and benefit derived from the authority's
30-44    groundwater reduction plan or a groundwater reduction plan in which
30-45    the authority participates.
30-46          SECTION 4.10.  ACQUISITION, CONSTRUCTION, AND OPERATION OF
30-47    SYSTEMS. (a)  The authority may:
30-48                (1)  acquire by purchase, gift, lease, contract, or any
30-49    other legal means a water treatment or supply system, or any other
30-50    works, plants, improvements, or facilities necessary or convenient
30-51    to accomplish the purposes of the authority, or any interest of the
30-52    authority, inside or outside the authority's boundaries;
30-53                (2)  design, finance, operate, maintain, or construct a
30-54    water treatment or supply system, or any other works, plants,
30-55    improvements, or facilities necessary or convenient to accomplish
30-56    the purposes of the authority, and provide water services inside or
30-57    outside the authority's boundaries;
30-58                (3)  lease or sell a water treatment or supply system,
30-59    or any other works, plants, improvements, or facilities necessary
30-60    or convenient to accomplish the purposes of the authority, that the
30-61    authority constructs or acquires inside or outside the authority's
30-62    boundaries;
30-63                (4)  contract with any person to operate or maintain a
30-64    water treatment or supply system the person owns; or
30-65                (5)  acquire water rights under any law or permit.
30-66          (b)  The competitive bidding laws provided by Chapter 49,
30-67    Water Code, apply to the authority.
30-68          (c)  The authority may, according to terms and conditions the
30-69    board considers desirable, fair, and advantageous, contract with a
 31-1    person outside the authority's boundaries:
 31-2                (1)  to allow the person to be included in a
 31-3    groundwater reduction plan adopted or implemented, in whole or in
 31-4    part, by the authority or in a groundwater reduction plan in which
 31-5    the authority participates;
 31-6                (2)  to sell water to the person; or
 31-7                (3)  to sell the person available excess capacity or
 31-8    additional capacity of the authority's water treatment or supply
 31-9    system.
31-10          (d)  The authority by rule may require that the plans and
31-11    specifications of water lines to be constructed within the
31-12    authority that are designed or intended to serve more than one
31-13    district or more than one person owning or holding a well permit
31-14    issued by the subsidence district under Chapter 151, Water Code, be
31-15    approved by the authority before the commencement of construction
31-16    of the water lines.
31-17          SECTION 4.11.  SALE OR REUSE OF WATER OR BY-PRODUCT. The
31-18    authority may store, sell, or reuse:
31-19                (1)  water; or
31-20                (2)  any by-product from the authority's operations.
31-21          SECTION 4.12.  CONTRACTS. (a)  The authority may enter into a
31-22    contract with a person for the performance of a purpose or function
31-23    of the authority, including a contract to design, construct,
31-24    finance, lease, own, manage, operate, or maintain works,
31-25    improvements, facilities, plants, equipment, or appliances
31-26    necessary to accomplish a purpose or function of the authority.  A
31-27    contract may be of unlimited duration.
31-28          (b)  The authority may purchase, acquire, finance, or lease
31-29    an interest in a project used for a purpose or function of the
31-30    authority.
31-31          (c)  The authority may contract for:
31-32                (1)  the purchase, sale, or lease of water or water
31-33    rights;
31-34                (2)  the performance of activities within the powers of
31-35    the authority through the purchase, construction, or installation
31-36    of works, improvements, facilities, plants, equipment, or
31-37    appliances; or
31-38                (3)  the design, construction, ownership, management,
31-39    maintenance, or operation of any works, improvements, facilities,
31-40    plants, equipment, or appliances of the authority or another
31-41    person.
31-42          (d)  The authority may purchase surplus property from this
31-43    state, the United States, or another public entity through a
31-44    negotiated contract without bids.
31-45          SECTION 4.13.  COOPERATION WITH AND ASSISTANCE OF OTHER
31-46    GOVERNMENTAL ENTITIES. (a)  In implementing this Act, the board may
31-47    cooperate with and request the assistance of the Texas Water
31-48    Development Board, the commission, the United States Geological
31-49    Survey, the subsidence district, other local governments, and other
31-50    agencies of the United States and this state.
31-51          (b)  The subsidence district may enter into an interlocal
31-52    contract with the authority to carry out the authority's purposes
31-53    and may carry out the governmental functions and services specified
31-54    in the interlocal contract.
31-55          (c)  The board shall endeavor to coordinate with the City of
31-56    Houston to develop a plan for a system to distribute surface water
31-57    in an economical and efficient manner to the authority.
31-58          (d)  In an attempt to minimize costs associated with
31-59    preparing a groundwater reduction plan, the board shall consider
31-60    the usefulness of water supply studies and plans prepared by or on
31-61    behalf of the North Harris County Regional Water Authority, the
31-62    City of Houston, or other governmental entities to the extent such
31-63    studies or plans are available and applicable to the authority.
31-64          SECTION 4.14.  GIFTS AND GRANTS. The authority may accept a
31-65    gift or grant from money collected by the subsidence district under
31-66    Chapter 151, Water Code, to fund the construction, maintenance, or
31-67    operation of a water treatment or supply system.
31-68          SECTION 4.15.  EXPENDITURES. (a)  The authority's money may
31-69    be disbursed only by check, draft, order, federal reserve wire
 32-1    system, or other instrument or authorization.
 32-2          (b)  Disbursements of the authority must be signed by at
 32-3    least a majority of the directors.  Notwithstanding any other law,
 32-4    the board by resolution may allow the general manager, treasurer,
 32-5    bookkeeper, or other employee of the authority to sign
 32-6    disbursements, except as limited by Subsection (c) of this section.
 32-7          (c)  The board by resolution may allow disbursements to be
 32-8    transferred by federal reserve wire system to accounts in the name
 32-9    of the authority without the necessity of any directors signing the
32-10    disbursement.  Disbursements of the authority's money by federal
32-11    reserve wire system to any accounts not in the name of the
32-12    authority must be signed by at least a majority of the directors.
32-13          SECTION 4.16.  AD VALOREM TAXATION. The authority may not
32-14    impose an ad valorem tax.
32-15          SECTION 4.17.  EMINENT DOMAIN. (a)  The authority may acquire
32-16    by condemnation any land, easements, or other property inside the
32-17    authority's boundaries to further authorized purposes, powers, or
32-18    duties of the authority.  The authority may acquire by condemnation
32-19    any land, easements, or other property outside the authority's
32-20    boundaries for the purposes of pumping, storing, treating, or
32-21    transporting water.  When exercising the power of eminent domain
32-22    granted by this section, the authority may elect to condemn either
32-23    the fee simple title or a lesser property interest.
32-24          (b)  The authority shall exercise the right of eminent domain
32-25    in the manner provided by Chapter 21, Property Code.  The authority
32-26    is not required to give bond for appeal or bond for costs in a
32-27    condemnation suit or other suit to which it is a party.  The
32-28    authority is not required to deposit more than the amount of an
32-29    award in a suit.
32-30          (c)  The authority may not use the power of eminent domain
32-31    for the condemnation of land for the purpose of acquiring rights to
32-32    underground water or for the purpose of acquiring water or water
32-33    rights.
32-34          (d)  The authority may not use the power of eminent domain
32-35    for the condemnation of property that is:
32-36                (1)  owned by a municipality with a population of 1.6
32-37    million or more or any instrumentality of a municipality with a
32-38    population of 1.6 million or more, including any local government
32-39    corporation created under Chapter 431, Transportation Code, to aid
32-40    or act on behalf of such a municipality; or
32-41                (2)  located within the municipal limits of a
32-42    municipality with a population of 1.6 million or more.
32-43          (e)  Notwithstanding Subsection (d)(2) of this section, the
32-44    authority may use the power of eminent domain to acquire property
32-45    that is not owned by a municipality of 1.6 million or more that is
32-46    within the municipal limits of a municipality with a population of
32-47    1.6 million or more if:
32-48                (1)  the property is located in an area of the
32-49    municipality that is less than 1,000 feet wide at its narrowest
32-50    point; or
32-51                (2)  the municipality grants permission for the
32-52    condemnation.
32-53          (f)  The authority may not exercise the power of eminent
32-54    domain under this section to acquire property of any kind in a
32-55    county that:
32-56                (1)  has a population of more than 245,000;
32-57                (2)  borders on the Gulf of Mexico; and
32-58                (3)  is adjacent to a county with a population of more
32-59    than 1.6 million.
32-60                        ARTICLE 5.  BONDS AND NOTES
32-61          SECTION 5.01.  REVENUE BONDS AND NOTES. (a)  The authority
32-62    may issue bonds or notes payable solely from revenue from any
32-63    source, including:
32-64                (1)  tolls, charges, rates, fees, user fees, and
32-65    special assessments the authority imposes or collects;
32-66                (2)  the sale of water, water services, water rights or
32-67    capacity, water transmission rights or services, water pumping, or
32-68    any other service or product of the authority provided inside or
32-69    outside the boundaries of the authority;
 33-1                (3)  grants or gifts;
 33-2                (4)  the ownership or operation of all or a designated
 33-3    part of the authority's works, improvements, facilities, plants, or
 33-4    equipment; and
 33-5                (5)  contracts between the authority and any person.
 33-6          (b)  Notes issued by the authority may be first or
 33-7    subordinate lien notes at the board's discretion.
 33-8          (c)  In connection with any bonds or notes of the authority,
 33-9    the authority may exercise any power of an issuer under Chapter
33-10    1371, Government Code.
33-11          (d)  The authority may conduct a public, private, or
33-12    negotiated sale of the bonds or notes.
33-13          (e)  The authority may enter into one or more indentures of
33-14    trust to further secure its bonds or notes.
33-15          (f)  The authority may issue bonds or notes in more than one
33-16    series as necessary to carry out the purposes of this Act.  In
33-17    issuing bonds or notes secured by revenue of the authority, the
33-18    authority may reserve the right to issue additional bonds or notes
33-19    secured by the authority's revenue that are on a parity with or are
33-20    senior or subordinate to the bonds or notes issued earlier.
33-21          (g)  A resolution of the board authorizing the bonds or notes
33-22    or a trust indenture securing the bonds or notes may specify
33-23    additional provisions that constitute a contract between the
33-24    authority and its bondholders or noteholders.
33-25          (h)  Bonds and notes may be additionally secured by deed of
33-26    trust or mortgage on any or all of the authority's facilities.
33-27          (i)  Section 49.181, Water Code, does not apply to bonds or
33-28    notes issued by the authority.
33-29          SECTION 5.02.  REFUNDING BONDS. The authority may issue
33-30    refunding bonds and notes to refund any of its bonds or notes in
33-31    any manner provided by law.
33-32                   ARTICLE 6.  MISCELLANEOUS PROVISIONS
33-33          SECTION 6.01.  FINDINGS RELATED TO PROCEDURAL REQUIREMENTS.
33-34    (a)  The proper and legal notice of the intention to introduce this
33-35    Act, setting out the general substance of this Act, has been
33-36    published as provided by law, and the notice and a copy of this Act
33-37    have been furnished to all persons, agencies, officials, or
33-38    entities to which they are required to be furnished by the
33-39    constitution and other laws of this state, including the governor,
33-40    who has submitted the notice and this Act to the commission.
33-41          (b)  The commission has filed its recommendations relating to
33-42    this Act with the governor, lieutenant governor, and speaker of the
33-43    house of representatives within the required time.
33-44          (c)  All requirements of the constitution and laws of this
33-45    state and the rules and procedures of the legislature with respect
33-46    to notice, introduction, and passage of this Act are fulfilled and
33-47    accomplished.
33-48          SECTION 6.02.  EFFECTIVE DATE. This Act takes effect
33-49    immediately if it receives a vote of two-thirds of all the members
33-50    elected to each house, as provided by Section 39, Article III,
33-51    Texas Constitution.  If this Act does not receive the vote
33-52    necessary for immediate effect, this Act takes effect September 1,
33-53    2001.
