                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the examination requirement for licensing as a chemical
 1-3     dependency counselor.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 504.157(c), Occupations Code, is amended
 1-6     to read as follows:
 1-7           (c)  An applicant who fails the examination may take a
 1-8     subsequent examination on payment of the required examination fee.
 1-9     [An applicant may not be reexamined more than three times.]
1-10           SECTION 2. The change in law made by this Act to Section
1-11     504.157(c), Occupations Code, applies to a person whose first
1-12     attempt to pass an examination under Section 504.156, Occupations
1-13     Code, occurs before, on, or after the effective date of this Act.
1-14     A person who failed an examination under Section 504.156,
1-15     Occupations Code, before the effective date of this Act may take
1-16     subsequent examinations as provided by Section 504.157(c),
1-17     Occupations Code, as amended by this Act.
1-18           SECTION 3.  This Act takes effect immediately if it receives
1-19     a vote of two-thirds of all the members elected to each house, as
1-20     provided by Section 39, Article III, Texas Constitution.  If this
1-21     Act does not receive the vote necessary for immediate effect, this
1-22     Act takes effect September 1, 2001.
