                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the prosecution and punishment of an individual who
 1-3     commits family violence within the view of a child.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Chapter 22, Penal Code, is amended by adding
 1-6     Section 22.03 to read as follows:
 1-7           Sec. 22.03.  FAMILY VIOLENCE COMMITTED WITHIN VIEW OF CHILD.
 1-8     (a)  In this section:
 1-9                 (1)  "Child" means a person younger than 17 years of
1-10     age.
1-11                 (2)  "Family" has the meaning assigned by Section
1-12     71.003, Family Code.
1-13           (b)  A person commits an offense if the person commits
1-14     assault punishable by confinement or imprisonment against a family
1-15     member and another member of the family who is a child witnesses
1-16     the commission of the offense.
1-17           (c)  An offense under this section is a Class B misdemeanor.
1-18           SECTION 2.  This Act takes effect September 1, 2001.
