1-1                                   AN ACT
 1-2     relating to control of contracts and funds of a commissary for the
 1-3     county jail of certain counties.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Subchapter C, Chapter 351, Local Government Code,
 1-6     is amended by adding Section 351.04155 to read as follows:
 1-7           Sec. 351.04155. COMMISSARY OPERATION BY SHERIFF IN CERTAIN
 1-8     COUNTIES. (a)  This section applies only to a county that:
 1-9                 (1)  has a population of one million or more; and
1-10                 (2)  has two municipalities with a population of
1-11     300,000 or more.
1-12           (b)  The county is subject to Section 351.0415, except:
1-13                 (1)  Section 351.0415(b)(1) does not apply to the
1-14     sheriff of the county;
1-15                 (2)  new bids to renew contracts under Section
1-16     351.0415(b)(3) are subject to the approval of the commissioners
1-17     court of the county;
1-18                 (3)  the sheriff may not make a disbursement from the
1-19     commissary proceeds unless the sheriff receives approval for the
1-20     disbursement from the commissioners court of the county; and
1-21                 (4)  the sheriff shall provide to the commissioners
1-22     court of the county each contract the sheriff makes under this
1-23     section relating to the commissary and shall provide the contract
1-24     within 10 days after the date the contract is made.
 2-1           SECTION 2. Section 351.0415(e), Local Government Code, is
 2-2     repealed.
 2-3           SECTION 3. This Act takes effect September 1, 2001.
