                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to control of contracts and funds of a commissary for the
 1-3     county jail of certain counties.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Subchapter C, Chapter 351, Local Government Code,
 1-6     is amended by adding Section 351.04155 to read as follows:
 1-7           Sec. 351.04155. COMMISSARY OPERATION BY SHERIFF IN CERTAIN
 1-8     COUNTIES. (a)  This section applies only to a county with a
 1-9     population of one million or more.
1-10           (b)  The county is subject to Section 351.0415, except:
1-11                 (1)  Section 351.0415(b)(1) does not apply to the
1-12     sheriff of the county;
1-13                 (2)  new bids to renew contracts under Section
1-14     351.0415(b)(3) are subject to the approval of the commissioners
1-15     court of the county;
1-16                 (3)  the sheriff may not make a disbursement from the
1-17     commissary proceeds unless the sheriff receives approval for the
1-18     disbursement from the commissioners court of the county; and
1-19                 (4)  the sheriff shall provide to the commissioners
1-20     court of the county each contract the sheriff makes under this
1-21     section relating to the commissary and shall provide the contract
1-22     within 10 days after the date the contract is made.
1-23           SECTION 2. Section 351.0415(e), Local Government Code, is
1-24     repealed.
 2-1           SECTION 3. This Act takes effect September 1, 2001.
