                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to control of contracts and funds of a commissary for the
 1-3     county jail.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Sections 351.0415(b) and (c), Local Government
 1-6     Code, are amended to read as follows:
 1-7           (b)  The sheriff:
 1-8                 (1)  [has exclusive control of the commissary funds;]
 1-9                 [(2)]  shall maintain commissary accounts showing the
1-10     amount of proceeds from the commissary operation and the amount and
1-11     purpose of disbursements made from the proceeds; and
1-12                 (2) [(3)]  shall accept new bids to renew contracts of
1-13     commissary suppliers every five years, subject to the approval of
1-14     the commissioners court.
1-15           (c)  The commissioners court shall [sheriff may] use
1-16     commissary proceeds only to:
1-17                 (1)  fund, staff, and equip a program addressing the
1-18     social needs of the county prisoners, including an educational or
1-19     recreational program and religious or rehabilitative counseling;
1-20                 (2)  supply county prisoners with clothing, writing
1-21     materials, and hygiene supplies;
1-22                 (3)  establish, staff, and equip the commissary
1-23     operation; or
1-24                 (4)  fund, staff, and equip a library for the
 2-1     educational use of county prisoners.
 2-2           SECTION 2. (a) The changes in law made by this Act to Section
 2-3     351.0415, Local Government Code, apply only to the renewal of a
 2-4     contract or the use of commissary funds that occurs in a county
 2-5     fiscal year that begins on or after September 1, 2001.
 2-6           (b)  The renewal of a contract or the use of commissary funds
 2-7     that occurs before September 1, 2001, is governed by the law as it
 2-8     existed immediately before that date, and the former law is
 2-9     continued in effect for that purpose.
2-10           SECTION 3. This Act takes effect September 1, 2001.
