No. 1890 1-2 (In the Senate - Received from the House May 9, 2001; 1-3 May 10, 2001, read first time and referred to Committee on 1-4 Intergovernmental Relations; May 11, 2001, reported favorably by 1-5 the following vote: Yeas 5, Nays 0; May 11, 2001, sent to 1-6 printer.) 1-7 A BILL TO BE ENTITLED 1-8 AN ACT 1-9 relating to control of contracts and funds of a commissary for the 1-10 county jail of certain counties. 1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-12 SECTION 1. Subchapter C, Chapter 351, Local Government Code, 1-13 is amended by adding Section 351.04155 to read as follows: 1-14 Sec. 351.04155. COMMISSARY OPERATION BY SHERIFF IN CERTAIN 1-15 COUNTIES. (a) This section applies only to a county that: 1-16 (1) has a population of one million or more; and 1-17 (2) has two municipalities with a population of 1-18 200,000 or more. 1-19 (b) The county is subject to Section 351.0415, except: 1-20 (1) Section 351.0415(b)(1) does not apply to the 1-21 sheriff of the county; 1-22 (2) new bids to renew contracts under Section 1-23 351.0415(b)(3) are subject to the approval of the commissioners 1-24 court of the county; 1-25 (3) the sheriff may not make a disbursement from the 1-26 commissary proceeds unless the sheriff receives approval for the 1-27 disbursement from the commissioners court of the county; and 1-28 (4) the sheriff shall provide to the commissioners 1-29 court of the county each contract the sheriff makes under this 1-30 section relating to the commissary and shall provide the contract 1-31 within 10 days after the date the contract is made. 1-32 SECTION 2. Section 351.0415(e), Local Government Code, is 1-33 repealed. 1-34 SECTION 3. This Act takes effect September 1, 2001. 1-35 * * * * *
