A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to a child safety fee in certain counties.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 502.173, Transportation Code, is amended
1-5 by amending Subsection (a) and adding Subsection (i) to read as
1-6 follows:
1-7 (a) The commissioners court of a county with a population
1-8 greater than 1.18 million may impose by order an additional fee of
1-9 not less than 50 cents or more than $3 [$1.50] for registering a
1-10 vehicle in the county. The commissioners court of a county with a
1-11 population less than 1.18 million may impose by order an additional
1-12 fee of not more than $3 [$1.50] for registering a vehicle in the
1-13 county.
1-14 (i) The commissioners court of a county shall impose a fee
1-15 of $3 under Subsection (a) on request of one or more municipalities
1-16 in the county that have an aggregate population that exceeds
1-17 two-thirds of the population of the county. The county shall adopt
1-18 the order imposing the fee and notify the department not later than
1-19 the 45th day after the date of the request. A fee requested under
1-20 this subsection may be removed only on written request of one or
1-21 more municipalities in the county that have an aggregate population
1-22 that exceeds two-thirds of the population of the county.
1-23 SECTION 2. Notwithstanding Section 502.173(c), Transportation
1-24 Code, a fee requested under Section 502.173(i), Transportation
2-1 Code, as added by this Act, on or before September 2, 2001, takes
2-2 effect January 1, 2002, regardless of whether the request was made
2-3 before the effective date of this Act. The county shall adopt the
2-4 order imposing the fee and notify the department not later than
2-5 October 10, 2001.
2-6 SECTION 3. This Act takes effect immediately if it receives
2-7 a vote of two-thirds of all the members elected to each house, as
2-8 provided by Section 39, Article III, Texas Constitution. If this
2-9 Act does not receive the vote necessary for immediate effect, this
2-10 Act takes effect September 1, 2001.
