                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to criminal mischief and theft of retail water utility
 1-3     service.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 28.03(b), Penal Code, is amended by
 1-6     amending subdivision (7) and by adding new subdivision (8) as
 1-7     follows:
 1-8           (b)  Except as provided by Subsection (f), an offense under
 1-9     this section is:
1-10                 (7)  a felony of the first degree if the amount of
1-11     pecuniary loss is $200,000 or more[.]; or
1-12                 (8)  a felony of the third degree regardless of the
1-13     amount of pecuniary loss, if the actor causes in whole or in part
1-14     impairment or interruption of public water, or causes to be
1-15     diverted in whole, in part, or in any manner, including
1-16     installation or removal of any device for any such purpose, any
1-17     public water supply.
1-18           SECTION 2.  Section 28.03(b)(3)(B), Penal Code, is amended as
1-19     follows:
1-20                       (B)  less than $1,500 and the actor causes in
1-21     whole or in part impairment or interruption of public
1-22     communications, public transportation, public water, gas, or power
 2-1     supply, or other public service, or causes to be diverted in whole,
 2-2     in part, or in any manner, including installation or removal of any
 2-3     device for any such purpose, any public communications, [public
 2-4     water,] gas, or power supply;
 2-5           SECTION 3.  This Act applies to acts committed on or after
 2-6     the effective date.
 2-7           SECTION 4.  This Act takes effect immediately if it receives
 2-8     a vote of two-thirds of all the members elected to each house, as
 2-9     provided by Section 39, Article III, Texas Constitution.  If this
2-10     Act does not receive the vote necessary for immediate effect, this
2-11     Act takes effect September 1, 2001.
