                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to prohibiting annexations by populous municipalities
 1-3     until certain municipal services are provided.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Subchapter B, Chapter 43, Local Government Code,
 1-6     is amended by adding Section 43.035 to read as follows:
 1-7           Sec. 43.035.  ANNEXATION PROHIBITED BY POPULOUS
 1-8     MUNICIPALITIES UNTIL CERTAIN MUNICIPAL SERVICES PROVIDED. A
 1-9     municipality with a population of 1.6 million or more may not
1-10     include an area in its annexation plan under Section 43.052 or
1-11     annex area under this chapter until:
1-12                 (1)  water and wastewater services are made available
1-13     to each lot adjacent to each street within the corporate boundaries
1-14     of the municipality; and
1-15                 (2)  each street with an adjoining ditch within the
1-16     corporate boundaries of the municipality is converted to a street
1-17     improved with curbs, gutters, and storm sewers.
1-18           SECTION 2. (a)  This Act takes effect September 1, 2001.
1-19           (b)  The change in law made by this Act applies to:
1-20                 (1)  the annexation of an area included in a
1-21     municipality's annexation plan under Section 43.052, Local
1-22     Government Code, regardless of the date on which the area was
1-23     included in the plan;
1-24                 (2)  the annexation of an area      under Subchapter
 2-1     C-1, Chapter 43, Local Government Code, regardless of the date on
 2-2     which the first hearing notice required by Section 43.063, Local
 2-3     Government Code, is published; and
 2-4                 (3)  the annexation of an area that is not included in
 2-5     an annexation plan during the period beginning December 1, 1999,
 2-6     and ending December 31, 2002, regardless of the date on which the
 2-7     first hearing notice required by Section 43.052, Local Government
 2-8     Code, as it existed immediately before September 1, 1999, is
 2-9     published.
