 1-7                            A BILL TO BE ENTITLED
 1-8                                   AN ACT
 1-9     relating to eligibility for and allotment under the food stamp
1-10     program for certain persons.
1-11           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12           SECTION 1. Chapter 33, Human Resources Code, is amended by
1-13     adding Section 33.0126 to read as follows:
1-14           Sec. 33.0126.  EXCLUSION OF PORTION OF INCOME OF CERTAIN
1-15     HOUSEHOLD MEMBERS. The department shall, to the maximum extent
1-16     allowed by federal law under 7 C.F.R. Section 273.11, as amended,
1-17     exclude the income of a person who is ineligible because of 8
1-18     U.S.C. Section 1612, as amended, to participate in the food stamp
1-19     program in determining:
1-20                 (1)  the eligibility for food stamps of another person
1-21     who is a member of the household in which the ineligible person is
1-22     a member; and
1-23                 (2)  the food stamp allotment for the eligible person.
1-24           SECTION 2. This Act takes effect September 1, 2001, and
1-25     applies to a person receiving food stamps on or after that date,
1-26     regardless of the date on which eligibility for food stamps was
1-27     determined.
