                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to termination or suspension of certain public school
 1-3     employees.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Chapter 22, Education Code, is amended by adding
 1-6     Subchapter D to read as follows:
 1-7                       SUBCHAPTER D. SUPPORT EMPLOYEES
 1-8           Sec. 22.101.  DEFINITION. In this subchapter, "support
 1-9     employee" means an employee of a school district who is not
1-10     entitled under Section 21.002 to be employed under a contract.
1-11           Sec. 22.102.  TERMINATION OR SUSPENSION WITHOUT PAY. A school
1-12     district may not terminate the employment of a support employee or
1-13     suspend a support employee without pay unless the employee's
1-14     supervisor recommends the action in writing to the superintendent
1-15     of the district.  The supervisor must state the reasons for the
1-16     proposed action.  The superintendent, after consideration of the
1-17     supervisor's recommendation, may reject or accept the supervisor's
1-18     recommendation.
1-19           Sec. 22.103. NOTICE OF DECISION.  If the superintendent
1-20     decides to accept the supervisor's recommendation of termination of
1-21     the employment or suspension of the support employee without pay,
1-22     the superintendent shall provide written notice to the support
1-23     employee of the decision and the reasons for the decision.
1-24           SECTION 2.  This Act applies beginning with the 2001-2002
 2-1     school year.
 2-2           SECTION 3.  This Act takes effect immediately if it receives
 2-3     a vote of two-thirds of all the members elected to each house, as
 2-4     provided by Section 39, Article III, Texas Constitution.  If this
 2-5     Act does not receive the vote necessary for immediate effect, this
 2-6     Act takes effect September 1, 2001.
