By Cook H.B. No. 1999 77R6749 JMC-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the authority of a magistrate in certain counties to 1-3 issue a search warrant for certain property or items. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Article 18.01(i), Code of Criminal Procedure, is 1-6 amended to read as follows: 1-7 (i) In a county in which the only judge serving the county 1-8 who is a licensed attorney is a district judge whose district 1-9 includes more than one county or in which the only judges serving 1-10 the county who are licensed attorneys are two or more district 1-11 judges each of whose district includes more than one county, any 1-12 magistrate may issue a search warrant under Subdivision (10) or 1-13 Subdivision (12) of Article 18.02 of this code. This section is 1-14 not applicable to a subsequent search warrant under Subdivision 1-15 (10) of Article 18.02 of this code. 1-16 SECTION 2. This Act takes effect immediately if it receives 1-17 a vote of two-thirds of all the members elected to each house, as 1-18 provided by Section 39, Article III, Texas Constitution. If this 1-19 Act does not receive the vote necessary for immediate effect, this 1-20 Act takes effect September 1, 2001.
