No. 1999 1-2 (In the Senate - Received from the House April 30, 2001; 1-3 April 30, 2001, read first time and referred to Committee on 1-4 Jurisprudence; May 10, 2001, reported favorably by the following 1-5 vote: Yeas 4, Nays 0; May 10, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the authority of a magistrate in certain counties to 1-9 issue a search warrant for certain property or items. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Article 18.01(i), Code of Criminal Procedure, is 1-12 amended to read as follows: 1-13 (i) In a county in which the only judge serving the county 1-14 who is a licensed attorney is a district judge whose district 1-15 includes more than one county or in which the only judges serving 1-16 the county who are licensed attorneys are two or more district 1-17 judges each of whose district includes more than one county, any 1-18 magistrate may issue a search warrant under Subdivision (10) or 1-19 Subdivision (12) of Article 18.02 of this code. This section is 1-20 not applicable to a subsequent search warrant under Subdivision 1-21 (10) of Article 18.02 of this code. 1-22 SECTION 2. This Act takes effect immediately if it receives 1-23 a vote of two-thirds of all the members elected to each house, as 1-24 provided by Section 39, Article III, Texas Constitution. If this 1-25 Act does not receive the vote necessary for immediate effect, this 1-26 Act takes effect September 1, 2001. 1-27 * * * * *
