By Salinas H.B. No. 2009 77R4912 SMJ-F A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to requirements for state funding for certain chemical 1-3 dependency treatment facilities. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter A, Chapter 464, Health and Safety Code, 1-6 is amended by adding Section 464.021 to read as follows: 1-7 Sec. 464.021. FUNDING REQUIREMENTS FOR CERTAIN TREATMENT 1-8 FACILITIES. (a) A contract between a treatment facility and the 1-9 commission that includes a provision for funding from the 1-10 commission must require the treatment facility to contract with the 1-11 Health and Human Services Commission for funding from the medical 1-12 assistance program under Chapter 32, Human Resources Code. 1-13 (b) The commission is the funding provider of last resort 1-14 for a treatment facility. 1-15 (c) The commission may not provide more than 50 percent of 1-16 the money used to fund treatment at a treatment facility. 1-17 (d) The commission shall adopt rules to implement this 1-18 section. 1-19 SECTION 2. (a) Section 464.021, Health and Safety Code, as 1-20 added by this Act, applies only to a contract for funding for a 1-21 treatment facility, as that term is defined by Section 464.001, 1-22 Health and Safety Code, that is entered into on or after the 1-23 effective date of this Act. A contract for funding for a treatment 1-24 facility that is entered into before the effective date of this Act 2-1 is governed by the law in effect at the time the contract is 2-2 entered into, and that law is continued in effect for that purpose. 2-3 (b) This Act takes effect September 1, 2001.
