1-1                                   AN ACT
 1-2     relating to the inspection of a commercial motor carrier's premises
 1-3     by municipal police officers.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 644.104, Transportation Code, is amended
 1-6     by adding Subsection (e) to read as follows:
 1-7           (e)  A municipal police officer who is certified under
 1-8     Section 644.101 may enter a motor carrier's premises to inspect
 1-9     equipment on a per unit basis or in a manner agreeable between the
1-10     motor carrier and the enforcement entity:
1-11                 (1)  at a reasonable time;
1-12                 (2)  after stating the purpose of the inspection; and
1-13                 (3)  by presenting to the motor carrier appropriate
1-14     credentials.
1-15           SECTION 2.  This Act takes effect immediately if it receives
1-16     a vote of two-thirds of all the members elected to each house, as
1-17     provided by Section 39, Article III, Texas Constitution.  If this
1-18     Act does not receive the vote necessary for immediate effect, this
1-19     Act takes effect September 1, 2001.
