1-1                                   AN ACT
 1-2     relating to establishing a historical representation advisory
 1-3     committee and ensuring equitable representation in monuments on
 1-4     state property.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Chapter 442, Government Code, is amended by
 1-7     adding Section 442.0087 to read as follows:
 1-8           Sec. 442.0087.  EQUITABLE REPRESENTATION IN MONUMENTS.
 1-9     (a)  In this section, "monument" has the meaning assigned by
1-10     Section 443.015, as added by Chapter 1141, Acts of the 75th
1-11     Legislature, Regular Session, 1997.
1-12           (b)  To ensure that the diverse history of Texas is
1-13     accurately represented on land owned by the state other than the
1-14     Capitol Complex, the Texas Historical Commission shall:
1-15                 (1)  collect information relating to each monument on
1-16     land owned by the state other than the Capitol Complex; and
1-17                 (2)  in cooperation with the chair of the history
1-18     department at Prairie View A&M University, at The University of
1-19     Texas at Austin, or at any other land grant university in the
1-20     state, as determined by the commission, ensure the:
1-21                       (A)  historical accuracy of the monuments; and
1-22                       (B)  equitable representation of all Texans,
1-23     including African slaves, African Americans, Hispanic Americans,
1-24     Native Americans, women in Texas history, and Texans exemplifying
 2-1     military service and rural heritage in monuments on land owned by
 2-2     the state other than the Capitol Complex.
 2-3           (c)  The commission shall make the information collected
 2-4     under this section available to the public.
 2-5           SECTION 2. Chapter 443, Government Code, is amended by adding
 2-6     Section 443.0081 to read as follows:
 2-7           Sec. 443.0081.  HISTORICAL REPRESENTATION ADVISORY COMMITTEE.
 2-8     (a)  To ensure that the diverse history of Texas is accurately
 2-9     represented in the Capitol Complex, the historical representation
2-10     advisory committee shall provide guidance to the board on the
2-11     addition of monuments to the Capitol Complex.
2-12           (b)  The advisory committee consists of the following 12
2-13     members:
2-14                 (1)  four members appointed by the governor;
2-15                 (2)  four members appointed by the lieutenant governor;
2-16     and
2-17                 (3)  four members appointed by the speaker of the house
2-18     of representatives.
2-19           (c)  In making appointments under this section, the governor,
2-20     the lieutenant governor, and the speaker of the house of
2-21     representatives shall attempt to include African American Texans,
2-22     Hispanic American Texans, Native American Texans, female Texans,
2-23     and Texans exemplifying rural heritage.
2-24           (d)  The governor shall designate the presiding officer of
2-25     the committee from among the members of the committee.  The
2-26     presiding officer serves a term of two years.
2-27           (e)  A member of the advisory committee serves at the
 3-1     pleasure of the appointing officer and serves without compensation
 3-2     or reimbursement of expenses.
 3-3           (f)  The advisory committee shall conduct meetings the
 3-4     committee considers necessary to provide guidance under this
 3-5     section.  The board shall provide necessary administrative support
 3-6     to the advisory committee.
 3-7           (g)  Subject to the approval of the board, the advisory
 3-8     committee shall develop its own bylaws under which it shall
 3-9     operate.
3-10           (h)  Chapter 2110 does not apply to the advisory committee.
3-11           (i)  The advisory committee is subject to the open meetings
3-12     law, Chapter 551.
3-13           (j)  The advisory committee is subject to Chapter 325 (Texas
3-14     Sunset Act).  Unless continued in existence as provided by that
3-15     chapter, the advisory committee is abolished September 1, 2007.
3-16           (k)  The advisory committee shall:
3-17                 (1)  collect information relating to each proposed
3-18     monument to the Capitol Complex; and
3-19                 (2)  in cooperation with the chair of the history
3-20     department at Prairie View A&M University, at The University of
3-21     Texas at Austin, or at any other land grant university in the
3-22     state, as determined by the committee, ensure the:
3-23                       (A)  historical accuracy of any proposed
3-24     monument; and
3-25                       (B)  equitable representation of all Texans,
3-26     including African slaves, African Americans, Hispanic Americans,
3-27     Native Americans, women in Texas history, and Texans exemplifying
 4-1     military service and rural heritage in additional monuments to the
 4-2     Capitol Complex.
 4-3           (l)  In this section, "monument" has the meaning assigned by
 4-4     Section 443.015, as added by Chapter 1141, Acts of the 75th
 4-5     Legislature, Regular Session, 1997.
 4-6           SECTION 3. Not later than January 1, 2002, the governor, the
 4-7     lieutenant governor, and the speaker of the house of
 4-8     representatives shall make appointments to the historical
 4-9     representation advisory committee under Section 443.0081,
4-10     Government Code, as added by this Act.
4-11           SECTION 4. This Act takes effect immediately if it receives a
4-12     vote of two-thirds of all the members elected to each house, as
4-13     provided by Section 39, Article III, Texas Constitution.  If this
4-14     Act does not receive the vote necessary for immediate effect, this
4-15     Act takes effect September 1, 2001.
