                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to compensation for services rendered at a polling place
 1-3     by election officers in a primary election.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 32.091, Election Code, is amended by
 1-6     amending Subsection (a) and adding Subsection (c) to read as
 1-7     follows:
 1-8           (a)  Except as provided by Subsection (c), an [An] election
 1-9     judge or clerk is entitled to compensation for services rendered at
1-10     a precinct polling place at an hourly rate not to exceed $6.  A
1-11     judge or clerk may be compensated at that rate for services
1-12     rendered under Section 62.014(c).
1-13           (c)  For a primary election, the rate may not exceed the
1-14     amount fixed by the appropriate authority, which amount must be at
1-15     least the maximum amount prescribed by Subsection (a).
1-16           SECTION 2.  Section 173.008, Election Code, is amended by
1-17     adding Subsection (e) to read as follows:
1-18           (e)  The secretary of state may not limit the state
1-19     compensation payable to election judges and clerks in a primary
1-20     election to reduce the minimum amount prescribed by this code.
1-21           SECTION 3.  This Act takes effect September 1, 2001.
