                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the eligibility of certain persons to serve as members
 1-3     of the State Board of Education or act as general counsel to that
 1-4     board.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1. Section 7.103, Education Code, is amended by
 1-7     amending Subsection (c) and adding Subsection (d) to read as
 1-8     follows:
 1-9           (c)  A person [who is required to register as a lobbyist
1-10     under Chapter 305, Government Code, by virtue of the person's
1-11     activities for compensation in or on behalf of a profession,
1-12     business, or association related to the operation of the board,]
1-13     may not serve as a member of the board or act as the general
1-14     counsel to the board if the person:
1-15                 (1)  is required to register as a lobbyist under
1-16     Chapter 305, Government Code; or
1-17                 (2)  for compensation, communicates directly with a
1-18     member of a governing body or an officer of a municipality, county,
1-19     school district, or other political subdivision on behalf of
1-20     another person with the intent to influence official action by the
1-21     governing body or officer.
1-22           (d)  In this section, "communicates directly with" has the
1-23     meaning assigned by Section 305.002, Government Code.
1-24           SECTION 2. This Act takes effect September 1, 2001.
