                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the eligibility of certain persons with mental illness
 1-3     for community-based services and support.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter B, Chapter 533, Health and Safety
 1-6     Code, is amended by adding Section 533.0385 to read as follows:
 1-7           Sec. 533.0385.  COMMUNITY-BASED SERVICES FOR CERTAIN PERSONS
 1-8     WITH MENTAL ILLNESS.  If a person with mental illness is admitted
 1-9     to a department facility for inpatient mental health services three
1-10     or more times during a 180-day period, the department shall presume
1-11     that community-based services and support are appropriate for the
1-12     person and that the person is eligible for those services and
1-13     support.
1-14           SECTION 2.  This Act takes effect September 1, 2001.
