                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to school district policy concerning possession of paging
 1-3     devices by students.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 37.082(b), Education Code, is amended to
 1-6     read as follows:
 1-7           (b)  The policy may provide for the district to[:]
 1-8                 [(1)]  dispose of a confiscated paging device in any
 1-9     reasonable manner after having provided the student's parent and
1-10     the company whose name and address or telephone number appear on
1-11     the device 30 days' prior notice of its intent to dispose of that
1-12     device.  The notice shall include the serial number of the device
1-13     and may be made by telephone, telegraph, or in writing[; and]
1-14                 [(2)  charge the owner of the device or the student's
1-15     parent an administrative fee not to exceed $15 before it releases
1-16     the device].
1-17           SECTION 2. This Act applies beginning with the 2001-2002
1-18     school year.
1-19           SECTION 3.  This Act takes effect immediately if it receives
1-20     a vote of two-thirds of all the members elected to each house, as
1-21     provided by Section 39, Article III, Texas Constitution.  If this
1-22     Act does not receive the vote necessary for immediate effect, this
1-23     Act takes effect September 1, 2001.
